Regulatory Compliance with Health and Safety. (a) It is agreed that Part 3 of the BC Workers Compensation Act, and the Occupational Health & Safety Regulation is incorporated into and forms part of this agreement. The Employer and the Union agree to abide by those provisions unless this agreement provides otherwise. Notwithstanding the foregoing, neither party is precluded from referring a matter to WorkSafeBC.

Any failure to comply with the Legislation or the Regulation shall be a matter for referral to the grievance procedure pursuant to the collective agreement. The employer and the union agree that an arbitrator has jurisdiction to consider matters arising from the legislation or regulation.
