RELICS. (a) Unless authorised to do so by a permit under section 87 or a consent under section 90 of the National Parks and Wildlife Xxx 0000 and subject to observance and compliance with any conditions imposed on the grant of such permit or consent the Licensee must not knowingly disturb, destroy, deface or damage any aboriginal relic or place or other item of archaeological significance within the Premises and shall take every reasonable precaution in drilling excavating or carrying out other operations or works in the Premises against any such disturbance, destruction, defacement or damage. (b) If the Licensee becomes aware of any aboriginal relic or place or other item of archaeological significance within the Premises the Licensee must within 24 hours notify the Licensor and the Chief Executive of the Office of Environment and Heritage of the existence of such relic place or item. (c) The Licensee must not continue any operations or works on the Premises likely to interfere with or disturb any relic, place or item referred to in sub- clause 30(b) without the approval of the Chief Executive of the Office of Environment and Heritage and the Licensee shall observe and comply with all reasonable requirements of the said Director-General in relation to carrying out the operations or works.

RELICS. ‌ If any Relics are found in, on or under the Works Site in connection with the Works, RMS will appropriately deal with those Relics in accordance with all applicable laws and, as between RMS and the City, the Relics will be owned by the City.
RELICS. 16.11.1 The Developer acknowledges that Relics may be found on or in the Land. If a Relic is found, the Developer must: (a) notify Council in writing within 5 Business Days of becoming aware of the existence of the Relic; (b) continue to perform the Activities as required by this Deed, except to the extent otherwise: (i) directed by any relevant Authority or ordered by a court or tribunal; or (ii) required by Law; (c) take all practical steps to prevent the Relic being disturbed, damaged or lost; (d) comply with any directions given by any relevant Authority relating to the handling of the Relic; and (e) comply with all Laws in respect of the Relic. 16.11.2 The Developer is not entitled to make, and Council will not be liable upon, any Claim (including for any Liability or Loss suffered or incurred by the Developer) arising out of or in connection with any Relic or any of the matters referred to in this clause 16.11 other than in respect of applying for a claim for an extension of time in accordance with clause 32.3.

  • Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates. (b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected. (c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)
