Relief for Complainant. Respondents agree to promote Fair Housing, by printing the Commission’s fair housing brochure, “Fair Housing and You,” and distributing the brochure to each of their rental units on or before September 1, 2017. Respondents agree to access the brochure on the Commission’s website at: xxxxx://xxxx.xxxx.xxx/sites/default/files/publications/2013/FairHousing_English_2013.pdf Respondents also agree to send a statement to the Commission, on or before September 1, 2017, verifying that the brochure was, in fact, distributed to each of their tenants with the number of rental units it was distributed to.
Relief for Complainant. Within seven business days of receiving Complainant’s signed Settlement Agreement, Respondents agree to pay Complainant $750.00 without any deductions, and send said check to him via certified mail. Respondents agree the Settlement Check will be made out to Xxxxxx Xxxxx and sent to him at his address listed on page one of this Settlement Agreement. Within seven days of receiving a Closing Letter from the Commission, Respondents agree to send a copy of the Settlement Check to the Commission.
Relief for Complainant. Within fourteen days (14) days of receiving a Closing Letter from the Commission, Respondents agree to pay Complainant Seven Hundred Fifty dollars ($750.00) without any deductions. Complainant shall be fully liable for any taxes associated with the settlement amount. Respondents agree the Settlement Check will be made out to [Name Redacted] and will be mailed to Xxxxxxx Xxxxxxx with the Iowa Civil Rights Commission at the address listed on page one of this Agreement. Xx. Xxxxxxx will send the Settlement check to Complainant.
Relief for Complainant. 13. Respondents Naicker and Sami agree to pay Complainant the sum total of ten thousand dollars ($10,000) as set forth herein: (1) the sum of five thousand dollars ($5,000.00) within fourteen (14) calendar days of the effective date of this Agreement; and (2) the sum of five thousand dollars ($5,000.00) at the time Complainant and all occupants vacate the premises, relinquish keys, and restore the premises to Respondents. Payment of the first sum will be made by cashier’s check made payable to NAME REDACTED and mailed to ADDRESS REDACTED via U.S. certified mail or other delivery service with tracking capability. Payment of the second sum will be made by cashier’s check made payable to NAME REDACTED and delivered, in person, to Complainant at the time she and all occupants vacate. Respondents shall be deemed to have satisfied the payment obligation required by this agreement by payment of the sums due hereunder, to Complainant named herein. To show compliance with paragraph X00, Xxxxxxxxxxx will provide a copies of the check identified above to the Department within thirty (30) business days of the effective date of this Agreement, together with a copy of the delivery tracking report or certified mail receipt or written receipt of key return as evidence of delivery. The photocopies of the checks and delivery information should be sent to the address specified in paragraph I33 of this Agreement.
14. It is understood that Complainant has agreed to vacate the premises on or before 11:59 p.m. on July 15, 2018. It is the express representation of Complainant that she is the only adult occupant in possession of the premises who may assert a claim of right to possession of the premises.
15. Respondent Naicker agrees to provide Complainant with a one thousand dollar ($1,000) rent credit for June 2018 and a rent credit of four hundred and eighty- three dollars and ninety cents ($483.90) for the first fifteen days of July 2018. Complainant acknowledges that Respondent Naicker has already provided the June 2018 rent credit. To show compliance with this paragraph X00, Xxxxxxxxxx Xxxxxxx will provide a copy of Complainant’s rent balance sheet showing zero owed for the first fifteen
Relief for Complainant. 15. Respondent/Recipient agrees to pay Complainant $10,000 within fifteen (15) days of the effective date of this Agreement. Payment will be in the form of a certified check or business check made payable to and mailed to Xxxxxx, Xxxxxx, 00000-0000. Respondents will provide a copy of the check to the Department within thirty (30) days of the effective date of this Agreement.
Relief for Complainant. 15. Respondent acknowledges that on June 9, 2020, Complainant submitted evidence of ongoing domestic violence perpetrated by a household member, and that this evidence is sufficient for Respondent to move to propose to terminate the alleged perpetrator’s participation in the Housing Choice Voucher program. Respondent agrees to issue the alleged perpetrator a Notice of Proposed Decision to Terminate Assistance (“Notice”) within one (1) year of the effective date of this Agreement. For the purpose of protecting Complainant’s safety, Respondent shall issue the Notice within ten (10) business days of being notified by Complainant’s representative that the household has officially broken up. Respondent shall not issue a Notice prior to receiving this notification. To show compliance with paragraph H15, Respondent will provide a copy of the Notice to the Department within fourteen (14) days of its mailing date. The copy shall be sent to the Department at the address specified in paragraph K24 below.
16. Respondent agrees that, should the alleged perpetrator request an informal hearing contesting the Notice, it will call Complainant as a witness and permit her to testify if she chooses to do so. Respondent shall coordinate the time, place and manner of Complainant’s participation with her representative so that Complainant can safely participate in the hearing. Complainant acknowledges that, due to the nature of an informal hearing, the alleged perpetrator has a right to cross-examine her if he so chooses. Complainant further acknowledges that, in accordance with Respondent’s Administrative Plan, the decision of the informal hearing officer is final, and that if the informal hearing officer overturns Respondent’s decision to terminate the alleged perpetrator’s assistance, Complainant and the alleged perpetrator will remain a single household with shared use of the Housing Choice Voucher. If the alleged perpetrator does not request an informal hearing, or if an informal hearing results in a decision upholding Respondent’s decision to terminate the alleged perpetrator’s assistance, Respondent agrees that the alleged perpetrator will be removed from the Housing Choice Voucher and Complainant will remain with the Housing Choice Voucher so long as Complainant is otherwise eligible under program regulations. Within fourteen (14) days of the date the hearing officer’s decision is issued, Respondent shall notify Complainant in writing as to whether the Notice was upheld ...
Relief for Complainant. 14. Respondent Bank of America agrees to pay Complainants the sum total of fifteen thousand dollars ($15,000) within fourteen (14) calendar days of the Effective Date of this Agreement. Payment will be in the form of a check made payable to To show compliance with paragraph G14, Respondent Bank of America shall provide a copy of the check and the tracking information to the Department within thirty (30) days of the Effective Date of this Agreement. The copies shall be sent to the Department at the email address specified in paragraph J20 below.
Relief for Complainant. Within 30 days of the effective date of this Agreement, Respondent shall provide, via wire transfer or any other mutually agreed upon method, $535,000 to Complainant in full and final satisfaction of this matter.
Relief for Complainant. Upon receiving a 10-Day Written Notice, Respondents agree to release Complainant from the terms of her rental agreement. Respondents agree to consider Complainant’s departure as a mutually agreed-upon termination of tenancy. Respondents agree not to seek any monies from Complainant for terminating her rental agreement before its January 31, 2019 expiration date. Once Complainant has vacated Apartment 7, Respondents agree to do a check-out of Apartment 7 with Complainant present (and her representative, if desired by Complainant) to confirm that it has been turned over to Respondents in the same condition as when Complainant moved in, normal wear and tear excepted. Complainant must schedule a time 24 hours in advance of the check-out so that Respondent can dispatch the appropriate personnel to the site. Once the inspection is completed, Respondents agree to immediately return Complainant’s $250.00 rental deposit less any cleaning or damage charges. Within seven (7) days of the check-out procedure occurring, Respondents agree to send the Commission documentation detailing any monies withheld from Complainant’s rental deposit for damage or cleaning.
Relief for Complainant. 16. Respondents/Recipients agree to pay Complainant the sum total of nine thousand dollars ($9,000.00) within thirty (30) days of the effective date of this Agreement. Said payment will be in the form of a certified or business check made payable to “Inland Fair Housing and Mediation Board” and mailed to Complainant via first class mail delivery with tracking capability to: Inland Fair Housing and Mediation Board, Attention Xxxxxx X. Xxxxxx, 0000 Xxxxx Xxxxx Xxx. Xxxxx 000, Xxxxxxx, XX 00000. Respondents will provide a photocopy of said check and delivery tracking information to the Department within ten (10) days of the payment to the address specified in paragraph I23 of this Agreement.
