Common use of Religious Holiday Leave Clause in Contracts

Religious Holiday Leave. A. A unit member may be absent, with pay, on a Religious Holiday not included in the school calendar. Observance of the Holiday as a day on which no work is to be performed must be required by a bona fide religious belief; this may be demonstrated by a showing that the Holiday is one that is so observed by a bona fide religion or religious body to which the member is an adherent holding such a belief. Such absence shall not exceed one (1) day during the school year. B. Requests for such absence shall be made in writing delivered to the Superintendent or his/her designee at least ten (10) school days prior to the Holiday. Where the Holiday occurs less than 10 school days after the beginning of the school year, the request shall be delivered on or before the end of the second working day of the school year. Where a request is denied, the unit member may request reconsideration by the Superintendent or his/her designee.
