REMOVAL OF UNSATISFACTORY PERSONNEL. Director or designee may make written request to the Consultant for the prompt removal and replacement of any personnel employed or retained by the Consultant, or any Sub-Consultants or subcontractors, or any personnel of any such Sub-Consultants or sub-contractors engaged by the Consultant to provide and perform services or Work pursuant to the requirements of this Agreement. The Consultant shall respond to the City within fourteen (14) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. All decisions involving personnel will be made by the Consultant. Such request shall solely relate to said employees work under this Agreement.
REMOVAL OF UNSATISFACTORY PERSONNEL. The City may make written request to the Design-Build Firm for the prompt removal and replacement of any personnel employed or retained by the Design-Build Firm, or any or Sub-Design-Build Firm engaged by the Design-Build Firm to provide and perform services or Work pursuant to the requirements of the Contract Documents. The Design-Build Firm shall respond to the City within seven (7) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. The City shall make the final determination as to the removal of unsatisfactory personnel from Work assigned by City. The Design-Build Firm agrees that the removal of any of its employees does not require the termination or demotion of employee(s).

The Town Manager may make written request to Consultant for the prompt removal and replacement of any personnel employed or retained by the Consultant, or any Subconsultants or subcontractors, or any personnel of any such Subconsultants or subcontractors engaged by the Consultant to provide and perform Services pursuant to the requirements of this Agreement. All decisions involving personnel will be made by Consultant. Such request shall solely relate to said employees work under this Agreement. Consultant shall defend, hold harmless and indemnify the Town and shall be liable and responsible for any and all claims, suits, actions, damages and costs (including attorney's fees and court costs) made against the County, occurring on account of, arising from or in connection with the removal and replacement of any Contractor's personnel performing services hereunder.

The Consultant shall respond to Town within seven (7) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. All decisions involving personnel will be made by Consultant. Such request shall solely relate to said employees work under this Agreement.
REMOVAL OF UNSATISFACTORY PERSONNEL. The COUNTY shall have the right, at its sole discretion to require the CONTRACTOR to remove any employee from the performance of services under this Agreement for unsatisfactory performance or any other job-related cause. At the request of the COUNTY, the CONTRACTOR shall replace said personnel within twenty-four (24) hours.

The Provider shall respond to the City within fourteen calendar days of receipt of such request with either the removal and replacement of such personnel or with written justification as to why removal is not warranted. All decisions involving personnel will be made by Provider. Such request shall solely relate to said employees work under this Agreement. In the event the City Manager disagrees with the justification offered by Provider, the City Manager's decision to replace
REMOVAL OF UNSATISFACTORY PERSONNEL. 29.1 If the City make written request to Provider for the prompt removal and replacement of any personnel employed or retained by Provider or a sub- provider, the Provider shall respond to the City within fourteen (14) days of receipt of such request with either the removal and replacement of such personnel or with a justification as to why the personnel were not removed. Said request shall solely relate to said employees or sub- providers providing Services under this Agreement.
REMOVAL OF UNSATISFACTORY PERSONNEL. Contractor shall at all times enforce strict discipline and good order among its employees and shall not employ under the Contract any unfit person or anyone not skilled in the Work to which they are assigned. The Town may make written request to the Contractor for the prompt removal and replacement of any personnel employed or retained by the Contractor. The Contractor shall respond to the Town within five (5) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. The Town shall make the final determination as to the removal of unsatisfactory personnel from the Work. The Contractor agrees that the removal of any of such individual(s) does not require the termination or demotion of said individual(s). The Town may request that a Contractor’s employee be removed for accepting gratuities.

The Contract Manager or Town Manager may make written request to Bank for the prompt removal and replacement of any personnel employed or retained by the Bank to provide and perform Services pursuant to the requirements of this Agreement. The Bank must respond to the Town within seven (7) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. All decisions involving personnel will be made by the Town. Such request will solely relate to said employees working under this Agreement and not as employees of the Bank or Subcontractor.
