Replacement of Artist.
(A) Unless AGMA shall otherwise order, an Artist may not be required to alternate with an Understudy or successor and if replaced by either, Artist may not thereafter be required (unless AGMA otherwise orders) to perform again in the role or to report at the theatre for that purpose. Payments, however, shall continue to be made to Artist according to the terms of Artist's Individual Artist Agreement except that the Producer shall receive credit for all monies earned by the Artist under another AGMA contract during the balance of the term of Artist's original contract.
(1) If the Artist is late for “half-hour” or appears at the theatre unable to perform due to intoxication or similar cause, the Producer, subject to the provisions of Section 3, ARBITRATION AND GRIEVANCE, may determine that the Artist should not perform. If the Artist is temporarily replaced for a single performance for reasons set forth herein, the above provisions shall not apply and the Artist may be required to perform thereafter, provided the Producer notifies AGMA in writing of such action and the reasons therefor within 24 hours. Should such temporary replacement be determined to be without just cause by an arbitrator or by other mutually agreeable means, the Artist shall be paid full salary for any performance not played as a result of the Producer's action and Artist shall continue to perform under Artist's original contract.
(2) Should the Producer dismiss an Artist for inability to perform due to intoxication or similar cause and so notify the Artist and AGMA in writing of such action and the reasons therefor within 24 hours, the provisions of Paragraph (A) above shall not apply. In such event, AGMA may institute Expeditious Grievance and Expeditious Arbitration procedures in accordance with Section 3. If it should be determined by the Arbitrator, or by other mutually agreeable means that the dismissal was without just cause, the Artist shall be paid full salary for any performances not played as a result of the Producer's action and shall be required to immediately resume Artist's performances when notified to do so by the Producer. Payment for the missed performances must be made prior to the Artist resuming performances under Artist's contract. Pending the determination, the Artist need not report to the theatre.
(B) Subject to the terms of Section 52(E), should the Contract of an Artist initially engaged for the production terminate, according to its terms, within five months...
