Replacement of Assigned Personnel. If the Judicial Council or a Participating JBE requests that the Contractor remove Assigned Personnel pursuant to paragraph H Termination of Assignment and Conversion, the Judicial Council or Participating JBE may, at its sole option, request that the Contractor provide a replacement candidate. If the Judicial Council or Participating JBE makes such a request, the Contractor shall submit a response to the Judicial Council or Participating JBE’s request as soon as practicable. The Contractor’s response will include resumes of the qualified candidates. In no event will the Contractor require more than ten (10) business days to submit such a response, unless the parties have agreed to an extended time period. If the Contractor identifies a replacement candidate that meets the Judicial Council’s or Participating JBE’s requirements and the Judicial Council or Participating JBE agrees the Judicial Council or Participating JBE may, at its sole option, either amend the Order to reflect the change in Assigned Personnel or issue a new Order. In the event the Judicial Council or Participating JBE does not agree to a replacement candidate and the Contractor is unable to find another suitable candidate for the Judicial Council or Participating JBE, the Judicial Council or Participating JBE may terminate the Order, in accordance with Appendix C, paragraph 7, Termination for Convenience. Upon the effective date of termination of the Order, the Contractor will not be obligated to complete the work of that Order and the Judicial Council or Participating JBE may submit the same or similar work order for bidding from other Contractors.
Replacement of Assigned Personnel. The Parties agree that “cause” for replacement of an assigned employee, as provided in City’s Specification for Detention Facility Security Services, shall be deemed established when City’s Chief of Police, or his designee, provides a written explanation to Contractor as to the reason why such action is necessary. The determination of the necessity for such action shall be within the sole and unfettered discretion of the Chief of Police or his designee.
Replacement of Assigned Personnel. If, at any time, ACCES is of the opinion, acting reasonably, that Service Provider or the personnel assigned by Service Provider to perform the Services do not possess the requisite skills, ability, knowledge, training or experience to perform the Services, or if Service Provider or the personnel assigned by Service Provider are not performing the Services in a manner acceptable to ACCES, ACCES may provide written notice thereof to Service Provider. Service Provider shall have ten (10) Business Days from the date of receipt of ACCES’ notice to take any appropriate steps to rectify the situation as requested by ACCES, including replacement of such person with a person with suitable skills, ability, knowledge, training or experience who is reasonably acceptable to ACCES.
