JUDICIAL COUNCIL. Judicial Council's waiver of any term, condition, covenant or waiver of a breach of any term, condition, or covenant shall not constitute the waiver of any other term, condition, or covenant or the waiver of a breach of any other term, condition, or covenant.
JUDICIAL COUNCIL. The Judicial Council may, at any time: 2.1.1. Direct Contractor to communicate with or provide notice to the Construction Manager and/or the Architect on matters for which the Contract Documents indicate Contractor will communicate with, or provide notice, to Judicial Council; and/or 2.1.2. Direct the Construction Manager or the Architect to communicate with or direct Contractor on matters for which the Contract Documents indicate Judicial Council will communicate with or direct Contractor.
JUDICIAL COUNCIL. The term “Judicial Council” means the State of California acting through Judicial Council of California, who is the owner of the Project.
JUDICIAL COUNCIL. 3.1.1 The Judicial Council has statutory authority and responsibility over court facilities. As the policymaking body for the judicial branch, the Judicial Council adopts policies governing court facilities including the 3.1.2 The Judicial Council has the responsibility and authority to “[e]xercise full responsibility, jurisdiction, control, and authority as an owner would have” over trial and appellate court facilities. (Gov. Code, §§ 69204(a) & (b), 70391(a) & (b).) 3.1.3 The Judicial Council has the responsibility and authority to “[m]anage court facilities in consultation with the trial courts.” (Gov. Code, 3.1.4 Judicial Council staff have the responsibility and authority to “provide the ongoing oversight, management, operation, and maintenance” of trial court facilities that have been transferred to the Judicial Council, and to “[c]arry out the Judicial Council’s policies with regard to” trial court and appellate court facilities. (Gov. Code, §§ 69206(a), 70392(a) & (b).) 3.1.5 Judicial Council staff are responsible for “[t]aking action on the operation of court facilities, including the day-to-day operation of a building … . Judicial Council staff must, in cooperation with the court, perform its responsibilities concerning operation of the court facility to effectively and efficiently support the day-to-day operation of the court system and services of the court.” Judicial Council staff may, when appropriate, delegate said responsibilities to the court so long as, among other things, the court facilities’ management is “consistent with the statewide goals and policies of the judicial branch” and facility- related decisions are “made with consideration of operational costs and enhance economical, efficient, and effective court operations.” (Cal. Rules of Court, rules 10.182, 10.184; Gov. Code, § 70392(e).) 3.1.6 The Administrative Director “has sole authority to assign, supervise, and direct staff” of the Judicial Council. (Cal. Rules of Court, Appx.   • Payment by the Judicial Council A. In accordance with the terms and conditions of this Agreement, the Judicial Council will pay the Contractor the actual cost not to exceed the total Contract Amount, as set forth in Table 1, below, for performing the Work of this Agreement. Payment will be at the prices set forth herein and based upon the actual and allowable cost to perform the Work.   • Limitation on Judicial Council 's Liability The Judicial Council will not be responsible for loss or damage to any non-Judicial Council equipment or property arising from causes beyond the Judicial Council's control. In any event, the Judicial Council's responsibility for repairs and liability for damages or loss shall be limited to that made necessary by or resulting from the negligent acts or omissions of the Judicial Council or its officers, employees, or agents. The Judicial Council will not be liable for any charges incurred in connection with this Program, or any Judicial Council activities, unless expressly provided for under this Agreement.

  • Judicial Review Any determination made by NYSERDA pursuant to this Exhibit that prevents the commencement of the time in which interest will be paid is subject to judicial review in a proceeding pursuant to Article 78 of the Civil Practice Law and Rules. Such proceedings shall only be commenced upon completion of the review procedure specified in Section 504.9 of this Exhibit or any other review procedure that may be specified in this Agreement or by other law, rule, or regulation.

  • Judicial Leave In the event an employee is summoned to serve as a juror, or required to appear as a witness in court for the District, or is named as a co-defendant with the District, the employee will be granted leave with pay for each day of required presence in court; provided, however, that any compensation received for service shall be remitted to the District.

  • Judicial Actions Issuance of a notice of Lien, levy, assessment, injunction or attachment against any Borrower’s Inventory or Receivables or against a material portion of any Borrower’s other property which is not stayed or lifted within thirty (30) days;
