Replacement Service. (i) If PBI determines that replacement is necessary, PBI will, at no additional cost, promptly ship new, reconditioned, or remanufactured equipment of the same or a functionally equivalent model to replace the affected Covered Equipment.
(ii) Unless PBI instructs you otherwise, within five (5) days of receiving the replacement equipment, you must pack the Covered Equipment to be replaced in the shipping carton that contained the replacement equipment, place the pre-paid return address label on the carton, and return it to PBI.
(iii) You are responsible for Covered Equipment until PBI receives it.
Replacement Service. Subject to Section 2.6(b), if for any reason outside EVE-PR’s control, EVE-PR or its Affiliates are unable to provide any element or sub-element of the Transition Service to any Service Recipient pursuant to the terms of this Agreement, EVE-PR shall, or cause its Affiliates to, provide to EVE-VEN substantially equivalent support in accordance with the terms of this Agreement, which such support shall be considered an element or sub-element of the Transition Service for the purposes of this Agreement.

Replacement Service. At Nortel’s request, Seller will deliver replacement Products, including FRU’s, after the expiration of the applicable Warranty Period. The prices for replacement FRU’s are set out in Section 3.3 below Nortel will pay freight expenses on the returned Product. Seller will pay the freight expenses for the shipment of replacement Product.
Replacement Service. The installation and Customer’s use of the Service is location-specific to the Service Location indicated in this Agreement and any Service Order. Customer may terminate Service at an existing Service Location without incurring Termination Fees provided that Customer orders and Midco accepts the order for a Replacement Service. The Replacement Service (a) must have a Term equal to or greater than the remaining Term of the existing Service; and (b) must have monthly recurring charges equal to or greater than the monthly recurring charges for the existing Service. In addition, Customer must (a) submit a Service Order to Midco for the Replacement Service at least ninety (90) days prior to terminating the existing Service; (b) reimburse Midco for any and all installation charges that were waived with respect to the existing Service; and (c) pay the actual costs incurred by Midco in installing and provisioning the Replacement Service.

Replacement Service. In the event Customer's business requirements change, requiring Customer to replace OC-3c/OC-12c Service provided hereunder ("Original Service") with new technology (hereinafter "Replacement Service"), Customer shall provide written notice of its intent to replace Original Service with Replacement Service from WorldCom. During the final six (6) months of the Customer Commitment Period, WorldCom shall not accept Customer orders for Replacement Service. Provided Customer is not in default of its obligations under this Agreement, Customer may cancel and upgrade Original Service to Replacement Service without being subject to any cancellation charge relevant to the Original Service under the following conditions: ***Confidential treatment has been requested for certain portions of this document. Such omitted portions have been filed separately with the Securities and Exchange Commission.
A. Customer shall provide WorldCom with at least forty-five (45) days' written notice prior to the effective date of cancellation of the Original Service and concurrently therewith submits a Service Order for Replacement Service having a Requested Service Date concurrent with the effective date of such cancellation.
B. The Replacement Service is available and uncommitteed.
C. The cities served by the Original Service continue to be served by the Replacement Service and when applicable, a reconfiguration of the Original Service which is available, i.e., cities served prior to the upgrade continue to be served by the Replacement Service following the upgrade. D. Customer will be liable for costs, if any, reasonably incurred by WorldCom from third parties (e.g., Local Access providers or interconnecting carriers) as a result of such cancellation, provided WorldCom notifies Customer of such costs within a reasonable time following receipt of Customer's Service Order to effect a cancellation and obtain Replacement Service. E. Replacement Service shall have a similar Minimum Monthly Commitment as Original Service. The Customer Commitment Period for Replacement Service shall be similar to the Original Service.
Replacement Service. At Nortel Networks’ request, Seller will deliver replacement Products, including FRU’s, after the expiration of the applicable Warranty Period. Nortel Networks will pay freight expenses on the returned Product. Seller will pay the freight expenses for the shipment of replacement Product.
Replacement Service. SecureCo may, by giving the Counterparty thirty (30) days prior notice, replace an existing Service on the Platform with another Service where the Charge for the new Service is not greater than the Charge for the Service being replaced and the functionality of the new Service is overall substantially the same as, or better, than the Service being substituted, as reasonably determined by SecureCo.
Replacement Service. WildBlue has the option to request expedited service for repair and replacement. Charges for this emergency service are shown in Schedule 16. In addition to the ability to expedite individual units, ViaSat may sign a maintenance agreement that covers all SMTSs shipped to ViaSat according to the terms of the agreement. If WildBlue has paid all applicable fees, or if WildBlue elects to expedite a specific repair case and agrees to pay the fees listed in Schedule 15, then:
