Requested Modifications. After the Development Program Thermage may request or Stellartech may suggest changes in the design or operation of the Products relating to improvements, or the reliability or serviceability thereof. The parties shall promptly discuss such modifications in good faith and Stellartech shall make any modifications requested or approved by Thermage, provided Thermage agrees to pay the reasonable costs of implementing such changes (including possible scrapping or reworking of existing units) which may alter the purchase prices hereunder as agreed by the parties.
Requested Modifications. The Customer hereby agrees to approve and to comply with the provisions established under Chapter 6 of the Access Code.
Requested Modifications. If a prospective mortgagee requires reasonable amendments, modifications, or supplements of or to the Mixed-Use Provisions as a condition to making a loan to Company, then the Town Bodies shall execute an agreement amending, modifying, or supplementing the Mixed-Use Provisions as required by the prospective mortgagee; provided that the foregoing shall apply only so long as: (i) there will be no material adverse effect on the Town Bodies, or the rights of the Town Bodies under the Mixed-Use Provisions; and (ii) the obligations of Company under the Agreement will not be reduced in any material respect.
Requested Modifications. If a prospective mortgagee requires reasonable amendments, modifications, or supplements of or to the Agreement as a condition to making a loan to Developer, then YRC shall execute an agreement amending, modifying, or supplementing the Agreement as required by the prospective mortgagee; provided that the foregoing shall apply only so long as: (i) there will be no material adverse effect on YRC, or the rights of YRC under the Agreement; and (ii) the obligations of Developer under the Agreement will not be reduced in any material respect.

After the Development Program, AtriCure, Inc. may request or Stellartech may suggest changes in the design or operation of the Products relating to improvements, or the reliability or serviceability thereof. The parties shall promptly discuss such modifications in good faith and Stellartech shall make any modifications requested or approved by AtriCure, Inc., provided AtriCure, Inc. agrees to pay the reasonable costs of implementing such changes (including possible scrapping or reworking of existing Products and Parts) in accordance with standard “time and materials” rates as provided in Exhibit A. It is understood that such modifications may alter the Product prices hereunder as agreed to by the parties.
Requested Modifications. Any request to modify the contract terms found in the Prerequisites section of IPRO or any of the requirements in this ITB must be submitted in writing using Attachment 4 – Modifications and Exceptions Form by the deadline for submitting questions, identified in the ITB Administrative Information on page 1 of this document. The State will not consider proposed modifications after the date and time set for submitting questions. The State cannot agree to material changes to the requirements, terms, or conditions after the ITB closes. Bids which are conditioned on the State accepting terms and conditions not found in the ITB, or which take exception to the State’s terms and conditions, will be found non-responsive and no further consideration will be given to the Bid.
Requested Modifications. As design and construction proceeds, the need for compromises and modifications could also arise. In the event that the Administrators or a party desires any additions or modifications to the other party’s improvements (“Requested Modification”) the Administrators or requesting party shall submit a written request along with plans and specifications for the Requested Modifications (that are coordinated with the Architect, the CMR and other consultants) to the other party for its approval. All Requested Modifications to the design or construction contracts can be jointly approved by the parties’ Administrators.
Requested Modifications. BSC may request or ArthroCare may suggest changes to improve the design or operation of the Products, or the reliability or serviceability of the Products. The parties shall promptly discuss such modifications in good faith and ArthroCare shall perform the engineering design work to modify the Specifications as requested by BSC, provided that BSC agrees to pay the reasonable costs of such work. If the changes require engineering design work on the Specifications, ArthroCare will prepare and submit to BSC for its approval a budget for the direct cost of making such work on a time and materials basis. The time will include the fully burdened rate for each employee involved in such work plus [*****] of the fully burdened cost to account for overhead.

Requested Modifications. If Landlord approves such proposed Tenant-Requested Modifications and if Landlord reasonably believes that the Tenant-Requested Modification will increase construction costs or result in a delay in design or construction of the Project Improvements, Landlord shall, within a reasonable time after receipt of Tenant’s request for a Tenant-Requested Modification in light of the scope of the request, provide to Tenant an estimate of costs for the design, permitting and construction of such Tenant-Requested Modification. After delivery of the estimate, Tenant shall have the right to revoke its request for the Tenant-Requested Modification for five (5) business days after delivery of such estimate.
