Requested Modifications. After the Development Program Thermage may request or Stellartech may suggest changes in the design or operation of the Products relating to improvements, or the reliability or serviceability thereof. The parties shall promptly discuss such modifications in good faith and Stellartech shall make any modifications requested or approved by Thermage, provided Thermage agrees to pay the reasonable costs of implementing such changes (including possible scrapping or reworking of existing units) which may alter the purchase prices hereunder as agreed by the parties.
Requested Modifications. The Customer hereby agrees to approve and to comply with the provisions established under Chapter 6 of the Access Code.

If a prospective mortgagee requires reasonable amendments, modifications, or supplements of or to the Agreement as a condition to making a loan to Developer, then YRC shall execute an agreement amending, modifying, or supplementing the Agreement as required by the prospective mortgagee; provided that the foregoing shall apply only so long as: (i) there will be no material adverse effect on YRC, or the rights of YRC under the Agreement; and (ii) the obligations of Developer under the Agreement will not be reduced in any material respect.

EXHIBIT G Net Income Projections/Pro-forma EXHIBIT H Appreciation Allocation Agreement The Appreciation Allocation Agreement shall include, without limitation, the terms and conditions set forth in this Exhibit. All capitalized terms used but not defined in this Exhibit shall have the meanings ascribed to such terms in that certain Economic Development Project Agreement (Yorktown Rebar Project) executed by and between YRC and Company to which this Exhibit is attached.
Requested Modifications. If, in connection with obtaining, continuing or renewing financing for the Building or any interest therein represents collateral in whole or in part, a lender shall request reasonable modifications of this Lease as a condition of such financing, Tenant will not unreasonably withhold, delay or defer its consent thereto, provided that such modifications do not increase the monetary obligations of Tenant hereunder or adversely affect to a material degree the Tenant’s leasehold interest hereby created.

After delivery of the estimate, Tenant shall have the right to revoke its request for the Tenant-Requested Modification for five (5) business days after delivery of such estimate.

After the Development Program, AtriCure, Inc. may request or Stellartech may suggest changes in the design or operation of the Products relating to improvements, or the reliability or serviceability thereof. The parties shall promptly discuss such modifications in good faith and Stellartech shall make any modifications requested or approved by AtriCure, Inc., provided AtriCure, Inc. agrees to pay the reasonable costs of implementing such changes (including possible scrapping or reworking of existing Products and Parts) in accordance with standard “time and materials” rates as provided in Exhibit A. It is understood that such modifications may alter the Product prices hereunder as agreed to by the parties.
