Reschedules. Buyer may only reschedule an order with Xxxxxx’s written consent. A reschedule should not extend further than an additional thirty (30) calendar days from original ship date requested. Reschedules may be subject to a ten percent (10%) penalty based on total amount of the order or portion of the order rescheduled.
Reschedules. Rescheduling of Hub Orders prior to Supplier’s shipment to a Hub will be governed by the Existing Purchase Terms. Following receipt of any reschedule request, Supplier will transmit a notice to EMS Provider and Hub Operator confirming receipt of the request and committing to new ship dates and/or Component quantities as per the reschedule request, to the extent consistent with the Existing Purchase Terms. Supplier will use commercially reasonable efforts to transmit the notice to both EMS Provider and Hub Operator within one business day after receipt of the reschedule request.
Reschedules. AMD may reschedule the delivery of any Purchase Order or portion thereof for Standard Products, without charge, one time only, upon notice to FASL at least thirty (30) days prior to the applicable delivery date. Standard Product reschedules may be made less than thirty (30) days prior to the applicable delivery date, but only upon the agreement of FASL. Any reschedules on less than thirty (30) days prior notice shall be subject to reschedule fees payable to FASL in an amount set by FASL in advance of AMD’s placement of the applicable Purchase Order. FASL will also determine reschedule policies, procedures and rights and charges with respect to Custom Products in advance of AMD’s placement of the applicable Purchase Order. FASL will inform all distributors of its reschedule policies in respect of Standard Products and Custom Products and apply such policies to all distributors although the parties acknowledge that exceptions may be made on a case-by-case basis to address particular Customer situations. The Parties will discuss in good faith any rescheduling of delivery of Custom Products, or of Standard Products where notice of rescheduling is given less than thirty (30) days prior to the applicable delivery date, requested by AMD, but the final determination will be FASL’s.

Fujitsu may reschedule the delivery of any Purchase Order or portion thereof for Standard Products, without charge, one time only, upon notice to Spansion at least thirty (30) days prior to the applicable delivery date. Standard Product reschedules may be made less than thirty (30) days prior to the applicable delivery date, but only upon the agreement of Spansion. Any reschedules on less than thirty (30) days prior notice shall be subject to reschedule fees payable to Spansion in an amount set by Spansion in advance of Fujitsu’s placement of the applicable Purchase Order. Spansion will also determine reschedule policies, procedures and rights and charges with respect to Custom Products in advance of Fujitsu’s placement of the applicable Purchase Order. Spansion will inform all distributors of its reschedule policies in respect of Standard Products and Custom Products and apply such policies to all distributors although the parties acknowledge that exceptions may be made on a case-by-case basis to address particular Customer situations. Upon notice to RMI, Purchaser may reschedule all or a portion of a purchase order for the Products at no charge as follows: Number of Days From Original Right to Delivery Date Reschedule 0-30 days No Reschedules 31-60 days Up to four (4) Reschedules, provided in each case that delivery is within thirty (30) days from original scheduled Delivery Date, and with an allowable increase of up to 25% of the purchase order amount, not to exceed 500 devices 61 days or more Unlimited Reschedules

Reschedules. CUSTOMER may reschedule all or part of a scheduled delivery one time per quarter (for a maximum of two quarters) for a period not to exceed forty-five (45) days. At the end of this forty-five day period, CUSTOMER shall either accept delivery of rescheduled finished units and/or pay BEMA’s Delivered Component Cost (BEMA’s quoted cost of Components as stated on the xxxx of materials plus a materials margin equal to 15%) associated with rescheduled units not yet built.

Reschedules. Buyer may only reschedule an order with Xxxxxx’s written consent. Orders scheduled to ship within a forty five (45) day window are considered frozen, and are not subject to reschedule. Changes to Orders which are submitted to Seller and provide for Product to ship between forty six (46) and ninety (90) days may affect no more than 50% of such Order (measured by quantity) and shall only be made through the end of the calendar quarter following the quarter in which the Order was placed. If such change accelerates a delivery time, Seller shall use commercially reasonable efforts to meet such delivery time and change, subject to the availability of any and all materials used to produce the Product. Conversely, Seller shall accept no more than one (1) change per Order that provides for the extension of a delivery date, whereby Seller must hold or store Product. In such event, Seller will notify Buyer of the storage of the Products and all risks of loss will pass to Buyer at the time the Products are placed in storage. The maximum postponement for any shipment will be thirty (30) days. Buyer shall be responsible for any and all expenses incurred by Seller for delay in shipment/delivery, including a ten percent (10%) penalty based on total amount of the order or portion of the order rescheduled. Xxxxx agrees to pay all expedite fees and other costs associated with the rescheduled date. Seller also may, at its sole option, submit its invoice for said rescheduled, delayed or stored Products to Buyer and Buyer will pay as set forth herein and reimburse Seller for all storage expenses. Notwithstanding the foregoing, payment for Product shall be due no later than thirty (30) days after the date upon which Seller ships the Product or the date upon which Seller stores such Product pursuant to a change as set forth in this Section.
