Resident Landfill Superintendent. The Company shall appoint a full-time manager of the Managed Assets (the "Resident Landfill Superintendent") who shall be trained, experienced and proficient in the management and operation of landfill assets comparable to the Managed Assets, and whose sole employment responsibility shall be managing the Company's performance of the Management Services. The primary residence of the Resident Landfill Superintendent shall be within a fifty (50) mile radius of the Landfill. The Company acknowledges that the performance of the individual serving as the Resident Landfill Superintendent will have a material bearing on the quality of service provided hereunder, and that effective cooperation between the County and the Resident Landfill Superintendent will be essential to effectuating the intent and purposes of this Agreement. Accordingly, a Resident Landfill Superintendent shall not be replaced except under extraordinary circumstances. If the Resident Landfill Superintendent is to be replaced, the County will be notified in writing as soon as reasonably possible prior to the date on which any candidate for Resident Landfill Superintendent is proposed to assume managerial responsibility for the Managed Assets. County complaints concerning the actions or inactions of the Landfill Supervisor will be handled in accordance with section 10.2 (H) and 10.4(D) below; however, if after repeated complaints by the County and corrective action by the Contractor, the County reasonably decides that an unworkable relationship has developed between the Contractor and the County, the Company shall replace the Landfill Supervisor. The Resident Landfill Superintendent shall meet with County representatives on at least a monthly basis to discuss the operations of the Managed Assets. All communications given to the Resident Landfill Superintendent shall be as binding as if given to the Company. The qualifications of the Resident Landfill Superintendent shall be submitted to the County and shall include maintaining a valid landfill operator's certificate. The Resident Landfill Superintendent will train one of the landfill operations xxxxxxx to perform the Resident Landfill Superintendent duties in his absence. This xxxxxxx shall be a SWANA certified manager of landfill operations as shall be the Resident Landfill Superintendent.

The appeal shall include a copy of the decisions of Level One and Level Two and the grounds for regarding the decision as incorrect. Within ten (10) days after receipt of the appeal, the Superintendent, or designee, shall communicate the decision in writing to all parties in interest. The decision shall include supporting reasons therefor.

  • CONTRACTOR SUPERVISION Contractor shall provide competent supervision of personnel employed on the job Site, use of equipment, and quality of workmanship.

  • Superintendence The Contractor shall maintain on site, at all times during the construction activities, a dedicated competent Superintendent. This person shall be acceptable to the County and shall have a cell phone at which he or she can be reached at all times. In addition to a General Superintendent and other administrative and supervisory personnel required for the performance of the Work, the Contractor shall provide specific coordinating personnel as reasonably required for interfacing of all the Work required for the total project, all satisfactory to County Project Manager. The superintendent shall not be changed except with consent of County Project Manager, unless the superintendent proves to be unsatisfactory to the Contractor and ceases to be in his employ, in which case he shall be replaced within twenty-four (24) hours by a superintendent acceptable to County Project Manager. The superintendent shall represent the Contractor in his absence and all directions given to him shall be binding as if given to the Contractor. Whenever, in the sole discretion of the County, the Contractor is not providing a sufficient level of supervision, the County may direct the Contractor to increase the level of supervision for any or all projects, including but not limited to the right to direct the Contractor to assign a full time, dedicated Superintendent for any project; submit daily management, inspection, activity, and planning reports; substitute Subcontractors; submit daily photographs of the work in place and the work areas prepared for the next day’s work; and develop a site specific quality control program, all at no cost to the County. In the event the County’s personnel are required to provide direction or supervision of the work in the field because the Contractor has not provided sufficient supervision, the Contractor shall reimburse the County $150 per hour for such effort.
