Level Three - Superintendent. Within ten (10) days of receipt of the decision rendered by the Executive Director of Human Resources, any party in interest may appeal the Director’s decision to the Superintendent, or designee, on forms provided by the School District and the Association. The appeal shall include a copy of the decisions of Level One and Level Two and the grounds for regarding the decision as incorrect. Within ten (10) days after receipt of the appeal, the Superintendent, or designee, shall communicate the decision in writing to all parties in interest. The decision shall include supporting reasons therefor.

Level Three - Superintendent. If the grievant is not satisfied with the Principal's decision rendered at Level Two, the grievant may, within eight (8) school days of receipt of that decision, appeal that decision to the Superintendent of Schools. The grievance must be submitted in writing stating the specific nature of the grievance and remedy requested and shall include a copy of the Level Two decision. The Superintendent may schedule a meeting at a mutually convenient time to discuss the grievance with the employee and the Association. Both parties reserve the right to include consultants in any such meeting. The Superintendent shall respond in writing together with supporting reasons to the employee, Association, and Principal within ten (10) school days from the date the grievance is filed at Level Three. This period may be expanded to twenty (20) school days if the Superintendent is unable to address the matter because of previous commitments.
Level Three - Superintendent. If the grievant is not satisfied with the decision of the immediate supervisor, the grievant may file the grievance in writing with the Superintendent within five (5) days after the decision at Level Two was received. The Superintendent shall have five (5) days in which to make a written response to the grievant. If the Superintendent determines that a hearing is warranted, he/she shall have five days from the date of that hearing to issue a written response.
Level Three - Superintendent. If satisfactory settlement has not been reached at Level Two, the individual shall present the grievance to the Superintendent within five (5) school days of the Principal's Level Two decision. The written grievance on Appendix B shall contain the details of the complaint and the corrective action desired by the individual. It must also give the date of the Level One informal discussion, as well as the date and substance of the Level Two decision. The Superintendent will meet with the Principal, the individual, and, if requested by the individual, a representative of the Association, in an attempt to resolve the grievance. A written decision will be given to the individual within five (5) school days of the meeting.
Level Three - Superintendent. If the aggrieved person is not satisfied with the disposition of the grievance at Level Two, or if no decision has been rendered within seven (7) school days after the presentation of the grievance at Level Two, the grievance may be filed in writing with the Superintendent within seven (7) school days of receipt or the earliest date when response was due. The Superintendent shall render his decision in writing within seven (7) school days after receiving the written grievance.
Level Three - Superintendent. The superintendent or his designee shall meet with the aggrieved person and the Union within five (5) school days of receipt of the grievance. Within ten (10) school days of receipt of the grievance, the superintendent or his designee shall indicate his disposition of the grievance in writing and shall furnish a copy thereof to the Union.
Level Three - Superintendent a. If a grievance is not satisfactorily resolved at Level Two, the grievant may appeal it to the Superintendent in writing, within ten (10) days following issuance of the Level Two written answer (or following the time when it should have been issued if it was not timely issued).

Level Three - Superintendent. If the grievant is not satisfied with the response of the immediate supervisor, he/she may file, within five (5) days a written form to proceed to Level 3. Within five (5) days of the filing of the form, the Superintendent or Superintendent/designee shall arrange and conduct a hearing in the same manner and for the same purpose as set forth in Level 1. Within five (5) days after the hearing the Superintendent or Superintendent/designee shall provide a written response to the Union and the grievant.
Level Three - Superintendent. In the event that either the Licensed Educational Interpreter or the EIA is not satisfied with the disposition of the grievance at Level Two, or if no decision has been rendered within seven (7) days from the date of the receipt of the grievance or the holding of the Level Two meeting, whichever is applicable, either the Licensed Educational Interpreter or the EIA may appeal the grievance in writing, stating the specific basis for the appeal to the Superintendent. A grievance may be filed at Level Three when the administrator involved at Level One and Two does not have the authority pursuant to BOARD policy to resolve the grievance. The superintendent or his/her designee shall, within seven (7) day of receipt of the Level Three appeals, conduct a meeting concerning the grievance. The meeting will include the Licensed Educational Interpreter who filed the grievance, EIA representatives, the Associate Director of the Related Services Department, the Principal, and the Superintendent or the Superintendents representative. Within seven (7) days after this meeting, the Superintendent or his/her designee will issue the decision along with he reasons, in writing, as to the final disposition of the grievance. A copy will be furnished to the aggrieved person, the EIA, the Associate Director of the Related Services Department, and the Principal involved.
Level Three - Superintendent. If the action of the Business Administrator or the individual’s immediate supervisor fails to resolve the grievance to the satisfaction of the Association, the grievance shall be referred to the Superintendent or his designated representative. Appeals to the Office of the Superintendent shall be reviewed and acted upon within ten (10) working days of receipt of formal request.
