Common use of Rest Period Clause in Contracts

Rest Period. 14.1 A full time employee, other than one recalled to work, shall be entitled to not less than ten consecutive hours off duty between the end of his or her ordinary day and the commencement of his or her ordinary work on the next day, unless otherwise agreed. 14.2 If on the instructions of the Company, a full time employee is required to resume or continue work without having had such ten consecutive hours off duty, he or she shall be paid at double the relevant minimum rate in clause 19 – Minimum wages, until he or she is released from duty for such period and he or she shall then be entitled to be absent until he or she has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. 14.3 Full time employees may voluntarily swap periods with the consent of the Company. In such circumstances the employee shall be entitled to not less than seven consecutive hours off duty. In the event that a full time employee works so much overtime at the end of his or her first work period that he or she is thereby unable to have seven consecutive hours off duty before the next work period, he or she shall not be entitled to any period off duty or to any payment under this clause.
