Restoration of Forfeited Amounts. If a Participant or former Participant who forfeited any portion of his Account balance pursuant to the provisions of Section 8.01 subsequently performs an Hour of Service, then the following provisions shall apply:

Restoration of Forfeited Amounts. If a Participant receives or is deemed to receive a distribution under this Section and the Participant resumes employment covered under the Plan, the Participant’s Employer Derived Account Balance shall be restored (from additional Employer contributions and/or forfeitures, as provided in Section 4.1.4) to the amount on the date of distribution if the Participant repays to the Plan the full amount of the distribution attributable to Elective Deferral and Employer contributions before the earlier of five years after the first date on which the Participant is subsequently re-employed by the Employer, or the date the Participant incurs five consecutive one-year Breaks in Service following the date of the distribution. If Participant is deemed to receive a distribution under this Section, and the Participant resumes employment covered under the Plan before the date this Participant incurs five consecutive one-year Breaks in Service, upon the reemployment of such Participant, the Employer Derived Account Balance of the Participant shall be restored to the amount on the date of such deemed distribution.
Restoration of Forfeited Amounts. If any portion of a Participant’s benefit that was forfeited and reallocated must be subsequently restored, then to the extent possible, the amount to be restored shall be allocated to the Participant’s Accounts from current forfeitures. If current forfeitures are insufficient, the Employer shall contribute in cash an amount sufficient enough when added to the current forfeitures to equal the required restored benefits. Any amounts restored shall be invested according to Section 5.3(d), including the default investment provisions thereof.

If an Employee who forfeited any portion of amount credited to his Matching Contribution Account and his Supplemental Contribution Account pursuant to the provisions of Section 9.01(a) subsequently performs an Hour of Service and is employed in a classification of employees that is eligible to participate in the Plan (determined under Article II), then the following provisions shall apply:

If, after the distributable amount is forfeited, the Participant or Beneficiary is located, the Plan will restore the forfeited amount (unadjusted for gains or losses) to such Participant or Beneficiary within a reasonable time. The method of restoring a forfeited benefit under subsection (a)(2)(ii) above applies to any restoration required under this subsection (2).
