Retention of Customer Content. Customer acknowledges that Smartsheet may, pursuant to its standard retention copy creation procedures or as a requirement of certain laws or regulations to which Smartsheet is subject, maintain copies or backups of Customer Content (including as part of records, documents, or broader data sets) beyond the period described in Section 5.1. In such cases, notwithstanding the requirements of Section 5.1, Smartsheet may continue to retain such Customer Content in copies or backups beyond the period prescribed in Section 5.1 provided that: (a) Smartsheet notifies Customer on termination of its need to retain such copies and/or backups; and (b) Smartsheet will continue to comply with all the requirements of the Agreement in relation to any such retained Customer Content.

Retention of Customer Content. During a Hosting Services engagement, IPRO will only retain Customer’s Content for a period of 30 days. This includes i) the original source or content sent to IPRO, ii) unused expanded discovery data, iii) processed or converted content published through IPRO’s Solution or delivered to Customer, iv) Duplicate content exported from IPRO’s Solution, v) content post-delivery to Customer. Customer may request to archive data using near-line storage at a lower rate to reduce storage fees. Customer will not have access to the database or data but IPRO can easily restore it when needed. It is Customer’s responsibility to validate the delivery of the Services and ensure all data is correct within IPRO’s retention period. After this period, IPRO shall not be responsible or liable for the deletion, damage, loss or failure to restore any of Customer Data or Customer Content. This does not apply to single-tenant subscriptions within the IPRO Solution fully managed by client.

  • Customer Content As part of the Services provided under this Agreement, Customer Data will be stored and processed in the data center region specified in the applicable Ordering Document. Axway shall not access Customer Content except in response to support or technical issues where Customer provides Axway with prior Customer’s written authorization required to access such Customer Content. Axway is not responsible for unauthorized access, alteration, theft or destruction of Customer Content arising from Customer’s own or its authorized users’ actions or omissions in contravention of the Documentation. Customer’s ability to recover any lost data resulting from Axway’s misconduct is limited to restoration by Axway from the most recent back-up.

  • Return of Customer Data Okta shall return Customer Data to Customer and, to the extent allowed by applicable law, delete Customer Data in accordance with the procedures and time periods specified in the Trust & Compliance Documentation, unless the retention of the data is requested from Okta according to mandatory statutory laws.
