Common use of Return from Leave Clause in Contracts

Return from Leave. If a leave of absence does not exceed thirty (30) days, the employee will be entitled to return to the same position, unit and shift held prior to the leave. Except as otherwise provided for in this Article 15, employees who return to work on a timely basis in accordance with an approved leave of absence agreement in excess of thirty (30) days shall be entitled to the first available opening for which the employee is qualified consistent with the provisions of the leave of absence agreement and the provisions of Section 7.2.

Return from Leave. If a leave of absence does not exceed thirty (30) days, the employee will be entitled to return to the same position, unit and shift work area held prior to the leave. Return from Leave. Except as otherwise provided for in this Article 15, employees who return to work on a timely basis in accordance with an approved leave of absence agreement in excess of thirty (30) days shall be entitled to the first available opening for which the employee is qualified consistent with the provisions or before expiration of the leave of absence agreement and the provisions of Section 7.2leave.

However, the provisions Employer shall not be required to reinstate any person who is not capable of Section 7.2performing the duties applicable to the position.
