Rights of the Seller a) To request the Buyer to pay the Sale Price of the Apartment in accordance with Article 3 of this Contract, and charge and request the Buyer to pay an interest thereon if the Buyer delays in making payment in accordance with the payment schedule as agreed in Clause 3, Article 3 of this Contract; b) To request the Buyer to take over the Apartment in accordance with the schedule as specified in this Contract; c) To reserve its ownership over the Apartment and refuse to hand over the Apartment or refuse to hand over the original LURC of the Buyer until the Buyer fulfills all of its payment obligations under this Contract; d) To replace the equipment, construction materials of the Apartment Building with the equipment, construction materials of the same quality in accordance with the laws on construction; The change of finishing equipment and materials inside the Apartment must be approved by the Buyer; đ) To exercise the rights and fulfill the duties of the Management Board of the Apartment Building pending the establishment of the Management Board of the Apartment Building; e) To unilaterally terminate this Contract in accordance with Article 15 of this Contract;
Rights of the Seller. 11.1 Pending establishment of the body corporate the Seller shall be entitled to: 11.1.1 Make conduct rules for the use and enjoyment of the common property; 11.1.2 Enter the Unit at all reasonable times or to authorise its agents or workmen so to enter, to inspect same or to carry out repairs; 11.1.3 To exercise all the rights and powers which the body corporate would be entitled to exercise in terms of the Act in respect of the Building, the land and the owners and/or occupants of the Units. 11.2 The Purchaser hereby appoints the Seller's nominee, irrevocably and in rem suam and with the power of substitution, to be his/her/its lawful agent and attorney: 11.2.1 To convene a meeting of the body corporate and there to vote in favour of any resolution of the body corporate to amend the rules or pass any other resolution as may be required: 11.2.1.1 By any bondholder for the grant of its consent to the opening of the sectional title register; 11.2.1.2 By the local or provincial authority and/or by the mortgagee prior to the grant of a sectional mortgage bond over a Unit in the Scheme; 11.2.1.3 By the Seller in order to ensure the proper and efficient management and control of the scheme, or to ensure that the Developer is able to exercise in full his rights to develop the Scheme further; 11.2.1.4 To sign all documents necessary or required to comply with the Purchaser's obligations in terms of this agreement.

Rights of the Seller and the Trustee in Respect of the Servicer. The Seller may, but is not obligated to, enforce the obligations of the Servicer hereunder and may, but is not obligated to, perform, or cause a designee to perform, any defaulted obligation of the Servicer hereunder and in connection with any such defaulted obligation to exercise the related rights of the Servicer hereunder; provided that the Servicer shall not be relieved of any of its obligations hereunder by virtue of such performance by the Seller or its designee. Neither the Trustee nor the Seller shall have any responsibility or liability for any action or failure to act by the Servicer nor shall the Trustee or the Seller be obligated to supervise the performance of the Servicer or otherwise.
Rights of the Seller. The Trustees shall afford the Seller, upon reasonable notice and during normal business hours, access to all records maintained by the Trustees in respect of their rights and obligations hereunder and access to officers of the Trustees responsible for such obligations. Upon request and at the expense of the Seller, the Trustee shall furnish the Seller with its most recent financial statements and such other information as the Trustee possesses regarding its business, property and condition, financial or otherwise. Rights of the Seller are protected The rights given to the Seller under the Guarantee and the Guarantor's Liabilities under it, are not affected by any act or omission of the Seller or any other person. For example, those rights and Liabilities are not affected by: (a) any act or omission: (i) varying or replacing this agreement; or (ii) releasing the Buyer or giving the Buyer a concession (such as more time to pay); or (b) acquiescence or delay by the Seller or any other person.
