Amendment (1) Any officer employed by any statutory body representing the Crown, or in the Public Service, who becomes an officer of the Commission shall retain all his existing and accruing rights. (2) Any such officer who becomes an officer of the Commission shall not thereby be required to resign his former position, but shall be granted leave of absence for the period of his service with the Commission, and the period of leave so granted shall for all purposes be included as part of the officer’s period of service. (3) Upon the termination of the service with the Commission of any such officer, who has not been dismissed for misconduct, he shall be entitled to be re-employed by his former employer with such advancement in status and salary, beyond the status held and the salary received by him in that service, immediately prior to his becoming an officer of the Commission, as the Public Service Board or such other body or person under whom such officer is employed thinks just. (4) In determining the status and salary to which the officer shall be advanced, the Public Service Board or such other body or person under whom such officer is employed shall take into con­ sideration the period of the officer’s service with the Commission.
