Sales Tax Reports. The OWNER shall provide or cause to be provided to the City any required permission to access information filed with the State of Texas related to sales taxes collected and remitted to the State of Texas by the OWNER on the Property promptly upon request by the City to allow the City to verify the amount of Sales Tax Rebate to be paid to the OWNER under this Agreement. The City shall not be required to pay the Sales Tax Rebate until the City has received all permissions required to access such information, and the Sales Tax Rebate shall be calculated solely on sales tax receipts that can be verified based on records held by the State of Texas.
Sales Tax Reports. OWNER/DEVELOPER agrees to cause all Generators to execute and deliver to the City a written direction, in form and content acceptable to the City and the Illinois Department of Revenue (“DOR”), authorizing the DOR to release to the City the sales tax figures for the Generator, on a quarterly basis or other DOR reporting basis during the term of this AGREEMENT. The City agrees to take the necessary action to initiate the transaction. Should the DOR cease to release the sales tax information to the City, OWNER/DEVELOPER and all Generators shall be responsible for any further action to obtain the sales tax information from the DOR and shall be responsible for submittal of the sales tax information from the DOR and shall be responsible for submittal of the sales tax information as provided for in the next paragraph of this AGREEMENT.
Sales Tax Reports. Developer shall submit to the City’s Golf Manager a copy of the monthly or quarterly sales tax report by the 10th of each month;
Sales Tax Reports. If the sales tax area reports described in Section 7.1.13 herein are unavailable or otherwise inadequate to allow computation of the Sales Tax Revenue, Owner shall timely acquire from each tenant a waiver of confidentiality or other document required or approved by the Texas Comptroller that allows City to review individual tenants’ reported sales tax information on a quarterly basis throughout the Term of this Agreement as necessary to compute the Sales Tax Revenue
Sales Tax Reports. The City and Home Depot designate this Agreement as a "revenue sharing agreement," thereby entitling the City to request annual sales and use tax information from the Comptroller, pursuant to Section 321.3022 of the Texas Tax Code, as amended. The City shall request in writing that the Comptroller issue sales tax reports pursuant to Section 321.3022 for total sales of Taxable Items consummated on the Property by Home Depot and the payment of Sales and Use Tax (the "Sales Tax Reports") for each calendar year during the term hereof. To the extent that the release of any such reports or information regarding the Sales and Use Tax collected by Home Depot for the sale of Taxable items consummated on the Property by Home Depot shall require the consent of Home Depot, Home Depot shall provide such consent to the City. Home Depot shall provide the sales tax identification numbers for Home Depot so that payments can be verified by the City.
Sales Tax Reports. Owner shall use commercially reasonable good faith efforts to acquire from each tenant a Tenant's Waiver in the form of Exhibit "E" or such other form that is reasonably approved by the Texas Comptroller's office that allows City to review such tenant's reported sales tax information on at least a quarterly basis throughout the Term of this Agreement. By July 31 of each year during the term of the Agreement, Developer will provide the City with: (a) a copy of any sales tax returns filed or received by it and, (i) to the extent in the Developer's possession, any other businesses located in the Development, or (ii) to the extent such sales tax returns of other businesses are not in the Developer's possession, then the City shall promptly obtain such information directly from the Texas Comptroller's Office (broken out by taxpayer based on geographic area), and such information directly obtained by the City shall be deemed to satisfy the requirements of this Section 4.5, and (b) an annual report certifying the status of compliance of all performance requirements accompanied by supporting documentation reasonably necessary to show full compliance of Developer's performance requirements. Said reports shall remain confidential as provided by state law.
Sales Tax Reports. As used herein, the term "Sales Tax Reports" ----------------- shall mean the statements and quarterly reports, and any other or supplemental reports, statements or submissions, actually filed or required to be filed by Participant with the State Board of Equalization relating to or in connection with the collection, remittance and/or calculation of Sales Tax Revenues from the Property and/or any other facilities owned or operated by Participant within the State of California. The Sales Tax Reports shall be delivered by Participant to Agency on or before January 31, April 30, July 31 and October 31 of each fiscal year (July 1-June 30).
Sales Tax Reports. Developer shall submit to Contract manager a copy of the monthly or quarterly sales tax report by the 10th or each month.
Sales Tax Reports. For the months of August 2020 through August 2021, Tenant shall provide to Landlord, on the tenth calendar day of each month, copies of the monthly sales tax returns submitted by Tenant to the Florida Department of Revenue.
Sales Tax Reports. Landlord is obligated, under the Disposition and Development Agreement between Landlord and the Orange Redevelopment Agency relating to the Retail Development, to furnish the Orange Redevelopment Agency sales tax reports for all tenants of the Retail Development. Therefore, in order to provide Landlord with the sales tax information from the State of California Board of Equalization ("Board") pertaining to Tenant's sales at the Leased Premises, Tenant agrees to provide Landlord with certified copies of all annual sales tax returns filed with the Board for Tenant's retail operations at the Leased Premises during the Term of this Lease. In addition thereto, Tenant shall provide Landlord with a power of attorney letter addressed to, and in a form satisfactory to, the Board authorizing the Board to release to Landlord all sales tax information for Tenant's retail operations at the Leased Premises during the Term of this Lease. Such letter shall be in the form attached hereto and made a part hereof as Exhibit G, or such other or additional forms as required from time to time by the Board in order to release such information to Landlord. Landlord agrees to maintain the confidentiality of any proprietary information received by Landlord pursuant to this Section 7.3.
