Common use of Seniority Retention Clause in Contracts

Seniority Retention. An employee whose employment has not been terminated by resignation, discharge or death, and whose seniority has not been lost under the terms of this Agreement will retain, but not accrue, unit seniority in these cases: (a) while on an authorized unpaid leave of absence so long as he/she complies with the conditions of such leave; (b) for ninety (90) days subsequent to promotion or assignment to a position not covered by this Agreement; and (c) while on layoff within the time limits specified in Paragraph 30.

An employee whose employment has not been terminated by resignation, discharge or death, and whose seniority has not been lost under the terms of this Agreement Paragraph 11, will retain, but not accrue, unit seniority in these cases: (a) while on an authorized unpaid leave lea ve of absence other than one specified in Paragraph 13, so long as he/she he complies with the conditions of such leave; , (b) for ninety (90) days subsequent to on promotion or assignment to a position not covered by this Agreement; and , (c) while on layoff within the time limits specified in layoff, until his loss of seniority rights under Paragraph 3015.

Seniority Retention. An employee whose employment has not been terminated by resignation, discharge or death, and whose his seniority has not been lost under pursuant to the terms of this Agreement Agreement, will retain, retain but not accrue, unit accrue seniority in these cases: : (a) while on an authorized unpaid leave of absence other than one specified In Section 17 so long as he/she he complies with the conditions of such leave; ; (b) for ninety (90) days subsequent to on promotion or assignment to a position not covered by this Agreement; and and (c) while up to two (2) years on layoff within layoff, or length of the time limits specified in Paragraph 30employee's seniority, whichever is the lesser.
