Seniority Rights on Re-Employment. ‌ (a) An employee who returns to work after the expiration of maternity or parental leave shall retain the seniority she had accrued immediately prior to commencing maternity or parental leave and shall be credited with seniority for the period of time covered by the maternity or parental leave. (b) The employee shall be deemed to have resigned on the date upon which her maternity or parental leave commenced if an application for re-employment is not made within one month prior to the expiration of the leave, or if she does not return to work after having applied for re-employment.
