Right to Refuse Unsafe Conditions. An employee has the right to refuse to carry out any work that the employee reasonably believes to be unsafe. An employee who refuses to carry out work thought to be unsafe must immediately report the unsafe condition to their supervisor. A supervisor receiving a report of unsafe work must immediately investigate the matter and ensure any unsafe condition is remedied without delay. If the supervisor does not agree that the work is unsafe, the employee may contact Worksafe BC to investigate the matter. No Employee shall be disciplined for refusal to work when excused by the provisions of the Workers' Compensation Act and Regulations.

Right to Refuse Unsafe ConditionsAn employee may exercise their right to refuse to do unsafe work. Whether the work an employee has refused to perform pursuant to the Occupational Health and Safety Regulation will be determined through a discussion with a Safety Committee representative of the Employer, and if required an on-site inspection. An on-site inspection can be completed by any of the following: • A member of the JHS Committee; or • A person designated by the JHS committee; or • A WorkSafeBC Safety Officer.

  • Right to Refuse to Cross Picket Lines (a) All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the appropriate legislation. Any employees failing to report for duty shall be considered to be absent without pay. (b) Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.
