Seniority Rights on Re-Employment. (1) An employee who returns to work after the expiration of her maternity and/or parental leave shall retain service credits and seniority rights accumulated prior to the maternity and/or parental leave and shall be credited with additional service credits and seniority for the period of time covered by the maternity and/or parental leave. (2) The employee shall be deemed to have resigned on the date upon which leave of absence without pay commenced if an application for re-employment is not made prior to the expiration of the leave or if the employee fails to return to work on the agreed to date.
