Common use of Seniority Rights Clause in Contracts

Seniority Rights. 1) Regular employees in receipt of a lay-off notice will be required to choose one of the following options in accordance with Article 14: a) lay-off with recall rights for one (1) year. A regular full-time employee or regular part-time employee who is laid off and chooses to place their name on the recall list rather than exercise their seniority rights shall be automatically recalled when a similar position in that particular classification becomes available. During the recall period, employees would be able to access work, for which they hold the required qualifications, from the on-call list. b) exercise bumping rights. It is understood that an employee who exercises their bumping rights is relinquishing any claim to their previous position and further recall. c) accept a severance payment according to clause 14.07. 2) The administration of bumping rights shall be as follows: a) a regular full-time employee in receipt of a lay-off notice will be entitled to bump the least senior full-time employee for whose job they possess the minimum qualifications. b) if a full-time position is not available, the employee will be entitled to bump the least senior part-time employee for whose job they possess the minimum qualifications. c) a regular part-time employee in receipt of a layoff notice will be entitled to bump the least senior part-time employee for whose job they possess the minimum qualifications. d) an employee who does not possess the minimum qualifications will be considered for the position by the Employer in a fair and equitable manner. e) an employee who bumps into a new position will be required to serve a probationary period of three (3) months. In the event an employee proves unsatisfactory during the probationary period or if the employee is unable to perform the duties of their new position, they shall be laid off in accordance with clause 14.08, section 1, subsection (a) and (c). f) On-call and temporary employees may not bump regular employees.

Seniority Rights. A. Seniority shall be defined for the purpose of this Agreement as being the length of continuous regular full-time employment within the bargaining unit. B. The University recognizes the principle of seniority for employees covered by this Agreement, and when qualifications such as ability, training, skill and other relevant qualities are considered equal by the University, the University will give preference in cases of promotion, transfer, shift assignments, layoff, and rehiring to employees with the longest service. C. The seniority and employment rights of an employee shall be terminated if the employee (1) Regular employees quits, (2) is discharged for cause, or (3) is laid off for a continuous period of six (6) calendar months. An employee who is promoted out of the collective bargaining unit shall retain but not accumulate seniority. An employee who leaves the service and is rehired shall be considered as a new employee for purposes of seniority and other benefits provided in receipt this Agreement. D. A seniority roster shall be maintained by the University and a copy posted at the place of employment. This list shall be kept up to date and the Association xxxxxxx will be furnished a copy upon request. The roster shall show the name of the employee, title, date of hire and status (lay-off notice off, leave of absence, promoted out of collective bargaining unit, etc.). Effective with signing of this contract, a roster will be required to choose one of the following options established in accordance with Article 14:the provisions of this Article. A posted roster will be subject to correction upon protest, provided such protest is made in writing within thirty (30) days of date roster is posted. Employees absent or on leave at the time the roster is posted shall have a period of at least thirty (30) days from the date of their return to file a protest. a) lay-off with recall rights E. In the event an employee proves unsatisfactory during the probationary period or if shall not be subjected to the employee is unable to perform grievance and arbitration procedure provided for herein, and the duties of their new position, they University shall be laid off in accordance with clause 14.08, section 1, subsection (a) and (c)under no obligation to reemploy any employee who has been suspended or discharged under these conditions or to pay him/her back wages. These provisions shall also apply to any non-bargaining unit employee who is transferred into this bargaining unit. f) On-call and temporary employees may not bump regular employees.
