Service Award Payments. At least fourteen (14) days before the Opt-Out and Objection Deadlines, Class Counsel will file a Fee Application that will include a request for Service Award payments for the Settlement Class Representatives in recognition for their contributions to this Action not to exceed $5,000 per Plaintiff ($10,000 total). The Settlement Administrator shall make the Service Award payments to the Settlement Class Representatives from the Settlement Fund. Such Service Award payments shall be paid by the Settlement Administrator, in the amount approved by the Court, no later than twenty (20) days after the Effective Date.
Service Award Payments. 1. As set out above in Section IX.A, in consideration for their commitment to the pursuit of the claims in this action on behalf of themselves and the Settlement Class Members, $30,000.00 of the Settlement Fund will be equally divided and paid to the two Named Plaintiffs.

If the Court does not approve the payment of these service awards, or approves the payments in a lesser amount, then any amounts allocated above that are not approved will revert to the Settlement Fund and will be treated in the same manner as any Unclaimed Funds being redistributed to Claiming Class Members as outlined in Section IV.E below.

Such Service Award Payment shall be paid by the Settlement Administrator, in the amount approved by the Court, no later than 7 days after the Effective Date.

AMU’s obligations with respect to the Court-approved service awards shall be fully satisfied upon receipt of the funds into the account established by Settlement Class Counsel. AMU shall have no responsibility for, interest in, or liability whatsoever with respect to any distribution or allocation of service awards. Nor shall AMU be responsible for any tax obligations or payments associated with the amount paid into the account established by Settlement Class Counsel. To the extent the Effective Date does not occur, AMU shall have no obligation to pay any service awards. This amount was negotiated after the primary terms of the settlement were negotiated.

Artech or the Settlement Administrator will pay the Service Award Payments separate and in addition to the relief provided to Settlement Class Members. Such Service Award Payments shall be paid in the amount approved by the Court no later than three (3) days after the Effective Date.
