SERVICE IN EQUAL OR LOWER CLASS. An employee who is laid off 36 from a class and who has previous service in an equal or lower class and who 37 has greater seniority, shall have the right to bump the employee having the 38 least seniority with a job profile that most closely approximates the 39 employee’s total annual hours in that class. (“Job profile” as used in this 40 section shall include the total service in that class plus service in an equal or 41 higher class including the class from which the employee is laid off.) 42

All renewal terms incorporated into a TIPS Sale Supplemental Agreement shall only be valid and enforceable when Vendor received written confirmation of acceptance of the renewal term from the TIPS Member for the specific renewal term. The purpose of this clause is to avoid a TIPS Member inadvertently renewing an Agreement during a period in which the governing body of the TIPS Member has not properly appropriated and budgeted the funds to satisfy the Agreement renewal.
