SHIPPING SCHEDULES. 9.1. At least fourteen (14) days prior to the Estimated Time of Arrival of the vessel at LOADING Point, BUYER shall nominate the vessel to THE SELLER for approval by SELLER, within one (1) working days after receipt, a fixed shipping schedule for that vessel. Such schedule shall specify : a) The tonnage of Coal to be loaded on board that vessel; b) The name of that vessel and its particulars; c) The estimated time of arrival (ETA) for that vessel; and d) Demurrage/Dispatch rate. 9.2. The quantity of Coal to be loaded into BUYER’s vessel may be varied by ten percent (10%) more or less of the notified quantity at the discretion of the vessels master, subject to the maximum tonnage to be sold and purchased as specified in Article 2. 9.3. BUYER shall ensure that the master of the BUYER’s vessel shall advise - in writing (e-mail, facsimile or telex)orby radio to SELLER or a person designated by the SELLER - its estimated time of arrival at the LOADING Point seven (7) days, five (5) days, and twenty four (24) hours before BUYER’s vessel is expected to arrive. 9.4. In the event that any Force Majeure conditions occur or are likely to occur regardless whether declared or not in accordance with Article 13 the treatment of the scheduled vessel may be discussed in good faith by BUYER and SELLER. However, once Force Majeure is declared in accordance with Article 13 by SELLER and if there appears, in the mutual opinion of both BUYER and SELLER, little likelihood for early conclusion to the Force Majeure condition, BUYER shall have the option to cancel any scheduled vessel under this agreement or divert it to other port (s) subject to Article 13.3 9.5. BUYER and SELLER shall use their best efforts to normalize shipping schedules as soon as possible after removal of Force Majeure.

SHIPPING SCHEDULES. Effective June 1, 2011, the shipping department will accept the multi-craft system. A Shipper A will be skilled to perform any job in the shipping department. A Shipper B will be qualified to load Xxxxxx cars, Xxxxxx trucks, cambelt, and drive a forklift to do anything the current forklift driver does. A Shipper C is qualified to load Xxxxxx cars, Xxxxxx trucks, and cambelt.
SHIPPING SCHEDULES. All orders should specify the delivery date desired by BUILDER. MESCO reorganizes its obligation to fill orders promptly and agrees that it will at all times use its best efforts to make shipments of ordered materials in the period shown on the order acknowledgement. However, MESCO shall not be liable for any damages due to late deliveries or delays in delivery.

However, in the event of any changes occurring, notices of such changes to be advised promptly.
SHIPPING SCHEDULES. Any shipping date shown on the acknowledgement represents the Company’s best estimate of the approximate shipping date as of the date of this acknowledgment. However, the Company shall not incur any liability of any kind whatsoever for failure to ship on any particular date unless the Company has expressly agreed to an unconditional firm shipping date in separately signed writing by the Company’s authorized personnel in Holland, Michigan.
SHIPPING SCHEDULES. The buyer agrees with the supplier on the commercial terms as well as the forecast of purchase/consumption of the materials/services.

  • DELIVERY SCHEDULES In accordance with the "Non-State Agencies Participation in Centralized Contracts” and “Extension of Use” clauses herein, this Contract is extended to local governments, political subdivisions and others authorized by law as well as State agencies. The Delivery Schedules (based on Requirement Letter RL182) are available as a guide to indicate proposed delivery points and estimated annual requirements. Delivery Schedules may be revised or clarified as necessary. Any specific questions regarding the site conditions should be directed to the end-user at the telephone number shown on the Delivery Schedule. The Delivery Schedules are available upon request. Contractors shall be obligated to deliver under the Contract to any State agency which places a purchase order under the Contract, whether or not such delivery location is identified in the Delivery Schedules. Any political subdivision or other non-State entity which has not filed a requirement with OGS as of the date of the bid opening shall be eligible to receive deliveries at Contractor's option only, upon placement of a valid purchase order to the Contractor's address as indicated in the award. Contracts created by OGS in response to receipt of Filed Requirements are considered to be binding. At Contractor's request, Contractor will be advised in writing regarding political subdivisions or other Non-State entities which have filed on a timely basis but do not appear on the Delivery Schedule. Where “Standby” is indicated in the Delivery Schedule, this reflects those facilities which normally use a fuel supply (i.e. natural gas) other than fuel oil and will only use fuel oil when alternate fuel is unavailable.

  • Pricing Schedule 7.1. The Pricing Schedule sets out details of the pricing of the Services. 7.2. The prices in the Pricing Schedule are not to be increased for the period of the Contract. 7.3. Accordingly, the Service Provider may not unilaterally increase the prices in the Pricing Schedule. But nothing in the Contract prevents the Service Provider from improving on the prices in the Pricing Schedule for the purposes of a particular Order.

  • Notice of Work Schedules ‌ (a) Work schedules for regular employees shall be posted at least 14 days in advance of the starting day of a new schedule. (b) In the event that the work schedule or shift for a regular employee or an auxiliary employee working a scheduled shift roster is changed without 48 hours' advance notice and such change is the result of the actions of another employee covered by this agreement utilizing the benefits provided for by the provisions of this agreement, the employee will receive a premium of 85¢ per hour in addition to their regular pay, for work performed on the first shift to which they changed. (c) In the event that an employee's work schedule or shift is changed without five days advance notice and the change results from causes other than defined in (b) above, the employee shall receive a premium at the applicable overtime rate for work performed on the first shift to which they changed, except that if the change results from no fault of the Employer they shall not receive a premium at overtime rates but shall receive the premium defined under (b) above.

  • Operating Schedule Purchaser shall, be- fore commencing operations, provide in writing an annual Operating Schedule of anticipated major activities and needs for logging Included Timber, such as logging, road maintenance, Scaling, and road construction, including construction staking under B5.212 and material delivery under B5.22. Upon reasonable notice to Forest Service, such schedule shall be subject to modifications necessi- xxxxx by weather, markets, or other unpredictable circum- stances.

  • Working Schedule The Employer agrees, in consultation with the Union, to set forth the working schedule of each department, hereinafter referred to as the "Work Schedule". The schedule shall be deemed to constitute Schedule "B" of this Agreement.

  • Delivery Schedule The Goods specified in the List of Goods are required to be delivered within the acceptable time range (after the earliest and before the final date, both dates inclusive) specified in Section V, Schedule of Requirements.
