Sick and Bereavement Leave. A. Sick Leave 1. Teachers shall earn and be credited sick leave at the rate of one (1) work day per month, the annual total of which shall be available at the beginning of the school year after the first day of duty. 2. The total unused portion of the annual sick leave allowance shall be permitted to accumulate to an unlimited amount. 3. All teachers may use their accumulated sick leave as of the first day of the school year, even though they have not been able to report for duty on that day, provided the teacher presents evidence of personal illness. 4. Employees who vacate their position and who have used more sick leave than earned shall be required to reimburse the Board and/or have their pay adjusted for the appropriate amount of days. B. A teacher shall be allowed five (5) consecutive work days (summer break not included) of absence from school without loss of salary on the death of a child, parent, brother, sister, husband, wife, same-sex domestic partner, mother-in-law, father-in-law, son-in- law, daughter-in-law, grandparents, grandchildren, stepchildren, brother-in-law, sister-in- law, grandparents of spouse, or of anyone who has lived regularly in the household of the teacher. Two consecutive days of bereavement leave will be allowed for the death of an aunt, uncle, niece, or nephew. C. Teachers under contract for less than full time shall be allowed sick leave and bereavement leave based on the percentage of time worked. D. Teachers shall, at their request, be allowed to use sick leave for absence due to disability connected with or resulting from pregnancy. Under this provision, such disability shall be treated as a temporary disability under all Board policies, and the teacher must return to work as soon as physically able, unless the teacher resigns or requests a leave of absence. E. Teachers who do not receive annual leave will be allowed to use up to ten days of sick leave for an illness in the immediate family or of a same-sex domestic partner.

Sick and Bereavement Leave. A. Sick Leave Section 1. Teachers Full-time employees shall be allowed 10 days of sick leave for each academic year. Sick leave shall be earned by an employee for any month in which the employee is in an active pay status for ten or more working days. Employees shall be eligible to take such leave after 30 days of service with the Employer. A sick or bereavement day shall be defined as for every hour of scheduled contact or office hour an employee is on sick or bereavement leave, the employee will be charged with 1.4 hours of leave. Section 2. Employees shall earn and be credited sick leave from their date of hire and there will be no limit on the amount of sick leave an employee may accumulate. Section 3. A doctor’s certificate is required for an absence from work due to sickness for three or more consecutive days. For absences of less than three days, a doctor’s certificate may be required where the Employer has reason to believe that the employee is abusing his/her sick leave privileges. Section 4. Where sickness in the immediate family requires the employee’s absence from work, employees may use not more than five days of such sick leave entitlement in each academic year for that purpose. Immediate family for the purpose of this Section is defined as the following persons: husband, wife, child, step-child, xxxxxx child, parent, brother or sister of the employee. The Employer may require proof of such family sickness in accordance with Section 3 above. Section 5. Where a family member’s serious health condition requires the employee’s absence from work beyond 20 days in an academic year, permanent employees with at least one year of service may use accrued sick leave, in addition to that provided by Section 4 above. a. Employees who meet the rate eligibility criteria in b. through e. below may use accrued sick leave in accordance with the following schedule: Leave Service Credit Sick Family Allowance Over 1 year to 3 years Up to 7 additional days Over 3 years to 15 years Up to 15 additional days Over 15 years to 25 years Up to 20 additional days Over 25 years Up to 26 additional days b. During the initial 20 days of one (1) work day per monthabsence, the annual total of which paid personal leave and/or unpaid leave shall be available at the beginning used and may include leave provided under Section 4 above. The additional sick family leave allowance must be used prospectively, and may not be retroactively charged for any of the school year after the first initial 20 days. A separate 20 day of duty. 2. Effective as soon as practically and legally possible, the Commonwealth will adopt a tax-qualified Leave Payout Plan. Sick and Bereavement Leave. A. Every employee shall be entitled to annual sick leave without loss of pay as follows: Number of Accumulated Annual Sick Leave Day Allotment at Sick Days as of June 30 the Start of Next School Year 1. Teachers shall earn and 0-59 12 2. 60-119 15 3. 120 - 179 20 4. 180+ 25 Probationary employees will be credited with two (2) days of sick leave at for use during the rate first month of employment, and will receive one (1) work day per monthmonth thereafter for the duration of the probationary period. Upon successful completion of the probationary period, the annual total employee will be credited with the remainder of his or her sick leave as provided herein. Probationary employees may request an advance of sick leave days from the Assistant Superintendent of Human Resources or designee, whose decision will be final, non-precedential and non- grievable. Unused sick leave which is not taken in any given year shall be available allowed to accrue as sick leave only to a maximum accumulation of two hundred fifty (250) days. B. Sick leave may be taken for personal illness, quarantine at home, or serious illness or death in the immediate family or household (parents, spouse, brothers, sisters, children, grandparents, grandchildren, parents-in-law, brothers-in-law, sisters-in-law and legal guardians), or birth, adoption, or placement for adoption. In addition to the foregoing, sick leave may also be used to attend to the death of aunts, uncles, nieces, nephews, step-parents, and step-children. C. Employees shall be notified by the building principal or his or her designee at the beginning of the school year after of the first day procedure for calling in absences. Except in emergency situations, a night shift employee shall notify his or her immediate supervisor a minimum of dutythree (3) hours before his or her work schedule is to begin of the need of taking said sick leave. The Board may, through the Assistant Superintendent of Human Resources or his/her designee, request the employee to put in writing the need for the use of sick leave and may require a medical certificate, secured from a District- designated medical program, to determine fitness to return to work or to take such leave, all as permitted by law. Employees may discuss with the Assistant Superintendent of Human Resources the medical program to which they will be referred. D. For purposes of this section, Immediate Supervisor shall mean: 1.
