Sick Leave Donation Bank. Purpose: The purpose of a sick leave donation bank is to provide a safety net for employees who face catastrophic illness or unforeseen medical emergencies that have exhausted sick leave, personal days, and paid vacation days, and do not qualify for long-term disability benefits. All bargaining unit employees shall be eligible to participate in a sick leave donation bank if they complete the correct forms on time. All bargaining unit employees who wish to participate in the sick leave bank must donate one (1) personal leave day or one sick leave day by completing the appropriate form (Form: LDON A-1) before September 30th of each year. a. When an employee faces a long-term absence from a serious illness (over five days) and has exhausted their sick leave, they can request days by contacting the Union Vice-President. The leave should be for the period of treatment for the illness whether that time is consecutive or intermittent. Recipients will be limited to forty- five (45) days per recipient in any given school year (form: LREQ A-2). The sick leave donation bank shall not cover normal delivery. b. If the Association Sick Leave Bank Committee determines that the recipient's request meets the purpose stated above and the conditions stated in this section, the Association will inform the District to draw from the bank. If the bank is exhausted, the Association Sick Leave Bank Committee will contact members of the bargaining unit to obtain additional donated days of leave. c. All bargaining unit employees who wish to donate leave day(s) to the bank must donate at least one (1) personal leave day or one (1) sick leave day by completing the appropriate form (form LDON A-1). No bargaining unit member can contribute more than five (5) total days per year. d. The Union Vice-President shall oversee operation of this sick leave donation program bank with the technical assistance of designated central office personnel. e. Unused sick leave donated to this bank will roll over to the next year. f. The maximum use of sick leave bank days per year for the unit will be limited to one hundred (100) days. g. The Association does hereby indemnify and will defend the District against all claims, charges, damages, judgements, legal fees, and costs incurred as a result of this sick leave bank. h. All provision under this Sick Leave Bank section and actions and determinations of the Sick Leave Bank Committee are not subject to the grievance process in this Agreement.

Sick Leave Donation Bank. Purpose: 1. The purpose Board and the Association shall join in the establishment of a sick leave donation bank voluntary Sick Leave Donation Bank for tenured teachers.
2. The intent of this plan is to provide extended sick leave of up to twenty (20) days in a safety net for employees school year to those teachers participating in the Sick Leave Donation Bank who face catastrophic incur a personal period of prolonged illness or unforeseen medical emergencies that hospitalization due to a life threatening illness or injury and have exhausted sick leave, personal days, and paid vacation days, and do not qualify for long-term disability benefits. All bargaining unit employees shall be eligible to participate in a all of their accumulated sick leave donation bank if they complete the correct forms on timeand personal leave.
3. All bargaining unit employees who wish Teachers shall indicate their willingness to participate in the sick leave bank must donate one Bank on an appropriate form to be supplied by the Association and filed with the Board on or before September 20th.
4. Each teacher wishing to participate in the Sick Leave Donation Bank shall contribute at least one
(1) personal leave day or one so as to establish a sufficient number of sick leave day by completing the appropriate form days to establish an initial bank of at least (Form: LDON A-120) before September 30th of each year.
a. When an employee faces a long-term absence from a serious illness (over five days) and has exhausted their sick leave. Thereafter, they can request days by contacting the Union Vice-President. The leave should be for the period of treatment for the illness whether that time is consecutive or intermittent. Recipients will be limited to forty- five (45) days per recipient in any given school year (form: LREQ A-2). The sick leave donation bank shall not cover normal delivery.
b. If the Association Sick Leave Bank Committee determines that the recipient's request meets the purpose stated above and the conditions stated in this section, the Association will inform the District to draw from the bank. If the bank is exhausted, the Association Sick Leave Bank Committee will contact members of the bargaining unit to obtain additional donated days of leave.
c. All bargaining unit employees teachers who wish to donate leave day(s) to continue participation in the bank must donate shall contribute annually at least one (1) personal leave day or day. Any teacher who drops out of the Bank for any reason after participating for at least one year, shall contribute three (13) days to the Sick Leave Donation Bank in the year that they choose to reenter..
5. Teachers who withdraw from the Bank for any reason shall not be allowed to withdraw days previously contributed.
6. Application for Use of the Sick Leave Donation Bank will be considered if all of the following criteria are met:
a. The Teacher shall submit a written application to the Sick Leave Bank Committee on a form provided by the Board requesting the use of up to a maximum of twenty (20) sick leave day days. The application shall be accompanied by completing a letter from the appropriate form (form LDON A-1)teacher’s doctor identifying the nature of the illness or injury. No bargaining unit member can contribute more than Maternity leave will be excluded
b. The Teacher shall have exhausted all of his/her personal leave and accumulated sick leave and been absent from employment for at least five (5) total consecutive days per without pay.
c. The Teacher shall not have previously used the Sick Leave Donation Bank in the current school year.
d. The Union Vice-President shall oversee operation Teacher may not be eligible for T.R.S. disability or any other type of this sick leave donation program bank with the technical assistance of designated central office personneldisability.
e. Unused sick The Teacher is not on a paid or unpaid leave donated to this bank will roll over to the next yearof absence.
f. 7. The maximum use Sick Leave Donation Bank Committee shall be composed of sick leave bank days per year for the Superintendent, one member appointed by the Board, the Association President and one member of the bargaining unit will be limited to one hundred (100) daysappointed by the Association.
g. 8. The Association does hereby indemnify and will defend the District against all claims, charges, damages, judgements, legal fees, and costs incurred as a result of this sick leave bank.
h. All provision under this Sick Leave Donation Bank section and actions and determinations Committee will make a decision on the request for use of the Sick Leave Bank and communicate that decision to the Teacher within five (5) school days of the submission. Decisions of the Committee are shall be final and not subject to the grievance process process.
9. Persons withdrawing days from the Sick Leave Donation Bank will not be required to replace those days except as a regular contributing member.
10. The superintendent shall report to the association the number of days currently in this Agreementthe sick leave bank, on or before August 31st.
