Sick Leave Pool. A. Sick Leave Pool. (d) The following procedures and criteria will be used to determine eligibility for benefits and the number of days after receiving to be granted:
1. The employee has exhausted his/her sick leave.
2. The employee has completed two (2) or more years of service in the Methuen Public Schools.
3. The employee, or in the event of incapacity, his/her representative, must obtain a Sick Leave Pool application to consider the requestform from a Sick Leave Pool Committee member. The application must be accompanied by an original, dated letter/note from a state certified medical doctor or nurse practitioner. This documentation must include the nature of the illness (diagnosis), a statement indicating that the member is unable to work in any capacity, as well as the anticipated date of return to work.
4. The Sick Leave Pool Committee may not award more than ten (10) sick days upon the initial application if substantiated by all the required documentation outlined on the MEA Sick Leave Pool application. Application must be made for additional benefits which may be sent awarded in increments of 30 days up to a total of 90 days. It is understood that it is not automatic that an employee will be covered for the building principal before entire illness and there is no guarantee that paychecks will not be interrupted. Leave taken pursuant to this Article will be deducted from the employee’s regular statutory leave entitlement under the Family and Medical Leave Act, if any.
5. The sex or marital status of the employee will have no basis in the decision to allow or deny sick leave endsbank benefits.
6. In the event of death, no sick leave granted by this committee will be paid to the employee’s estate, nor shall sick leave be paid to an employee who has been terminated, or resigned from his/her position.
7. Sick leave days drawn from the bank will be actual workdays in which school was in session excluding weekends, holidays, school closing and vacation periods.
8. All policies and procedures should be kept by all Unit C members as a reference. The Emergency policies and procedures will be strictly adhered to in all respects.
(e) Actions taken by the Sick Leave Pool Committee on sick leave pool requests will be forwarded to the Superintendent for his/her approval.
(f) No decision of the Sick Leave Pool Committee will consist be subject to the grievance and arbitration provisions of six membersthis Agreement. One member from each Any appeal will be limited to an appeal to the Sick Pool Committee itself.

Once an employee is determined eligible for receipt of sick pool days, the committee may approve withdrawals in units of up to thirty (30) days, with the employee eligible to reapply for receipt of additional days. The committee's decision on approving or denying the application again will be deemed final.
8.8.4 Members of the bargaining unit are eligible to join the sick bank. In addition, administrators employed by the District are also eligible to join the sick bank.
8.8.5 If the committee members believes that the sick pool is or will serve be depleted, the committee may, regardless of the contribution window set forth above, reopen the pool for contributions. Such reopening for contributions will be for a period of two years. Sick Leave Pool. The purpose Sick Leave Pool (SLP) shall be instituted July 1, 2007.
1. The SLP will be administered on a fiscal-year basis (July 1 to June 30). NTCFA employees will add days to the pool.
2. Human Resources personnel will administer the solicitation of the emergency sick leave pool is to furnish additional sick days for certified staff under the negotiated agreement. 5. Days from the SLP are not available for situations covered by Worker's Compensation.
6. Days from the SLP are not available for Family and Medical Leave Act situations, other than personal illness or personal injury.
7. An employee granted days from the SLP, does not have to reimburse the SLP or the District for the days utilized.
8. Before an employee can be granted days from the SLP, he/she must exhaust his/her personal accumulated sick leave. To ascertain this, an employee's leave record will be sent reviewed on the date that his/her personal accumulated sick leave is exhausted.
9. To be granted days from the SLP, an employee must have been absent for at least the preceding ten working days. However, if an employee is granted days from the SLP, returns to work, and is in need of additional days from the SLP, the above "buffer" shall be changed to five workdays.
10. In the event that the SLP balance becomes depleted to the building principalpoint where 25 days or less remain, Human Resources will notify the SLP Committee within a reasonable time period. Sick Leave Pool. A. A Sick Leave Pool for employees covered by the Local 129 Bargaining Unit shall be established from voluntary donations of sick leave days.
B. Each year, during the month of October, each Bargaining Unit member may donate up to eight (8) days to the Sick Leave Pool by using the Sick Leave Donation Form (Form K) and sending this form to the OAPSE 129 President. In the event the Sick Leave Pool balance falls below 120 days, an additional window of opportunity to donate to the Sick Leave Pool will be made available. Members are strongly discouraged from donating to the Sick Leave Pool if they have fewer than 30 sick leave days accumulated.
C. Once an employee donates sick leave and the leave is forwarded to the Board through the Union President (using the sick leave donation Form J), the sick leave donation is irrevocable. The purpose sick leave donation will remain in the Sick Leave Pool indefinitely, until such time as it is needed by a qualifying Bargaining Unit member.
D. An employee may use the Sick Leave Pool if s/he has met all the following criteria:
1. The employee has applied for SERS disability retirement or private disability insurance benefits whichever is applicable, within thirty (30) calendar days from the start of use of the emergency sick leave pool is to furnish additional sick days for certified staff under the negotiated agreementbenefit. 5. An administrator from the Human Resources Department and the Bargaining Unit President will jointly review each application and will make a recommendation to the Superintendent of Schools who will make the final decision as to the eligibility of the applicant.
E. In the case of an employee qualifying for Sick Leave Pool days because of personal illness or injury, said days shall be granted for catastrophic illness in ten (10) day increments until the employee clearly needs no more or injury goes on SERS disability retirement. When an employee is medically able to return to work after use of the employee only, on a first-come, first-ask basis. Sick Leave Pool. The purpose a. Exceptions may be made if the use of the Sick Leave Pool will enable the teacher to complete 120 work days for purposes of STRS benefits or in the event of a unique and extreme financial hardship.
g. The Superintendent may require a doctor’s certificate verifying eligibility. The decision to grant use of the Sick Leave Pool is made by the Superintendent. If the Superintendent and B.E.A.
