EXPERIMENTAL PROGRAMS. 27.1 The acceptance or rejection, planning, budgeting, implementing and evaluating of all experimental educational programs in Polk County schools shall include the active involvement of all teachers to be affected on the school level. On programs designated as experimental by the Board, the Association will be involved. 27.2 The School Board and the Association recognize that arrangements in which employees share responsibility for decision making such as site-based decision making and innovations related to District Strategic Plan can xxxxxx the collegial exchange of ideas and information that can enhance effective professional practice and improve the educational process. 27.3 The Association and the School Board reserve all collective bargaining rights under the law or existing collective bargaining agreements. 27.4 Introduction In an effort to improve instruction and student performance in a school that earns a grade of “D” for two (2) or more consecutive years, or a school grade of “F,” the School Board and the Association agree to implement Section 27.6. 27.4-1 Planning Year Following the initial designation of a school as having two (2) or more consecutive grades of “D,” or a designation of “F” Priority, a planning year will occur. During this planning year, the District and school will complete a rigorous evaluation of the existing leadership team, coaches, staff, curriculum, support/interventions and resource allocation. The Superintendent or Deputy Superintendent will meet at least monthly with the PEA President and share the results of the evaluation and the developing plan for turning around the students’ performance and the school grade. Before any documentation or template is submitted to the Florida Department of Education (FDOE) regarding the District’s Turnaround Plan, it will be shared with the PEA President who will be provided an opportunity for input with regard to contractual and legal concerns. 27.4-2 Subsequent Years For subsequent years (after the initial first year), until such time as the school meets the District’s exit criteria for schools having two (2) or more consecutive grades of “D,” or an “F” Priority School:
EXPERIMENTAL PROGRAMS. Experimental programs involving technological and mechanization changes are within the scope of this Article.
EXPERIMENTAL PROGRAMSThe Association and the Board agree to promote improved student achievement through innovative experimental programs and assessment strategies. The intent of this Section is to promote educational creativity and student learning, not to displace current programs or staff assignments. The Board of Education and the Sheffield-Sheffield Lake Teachers Association further agree to waive only those sections of the Agreement that may come into conflict with experimental programs and assessment strategies. Teachers who agree to develop and implement programs and assessment strategies that impact the negotiated Agreement for a school year or a part of a school year must obtain the acknowledgement of the Superintendent and the SSLTA Executive Committee before being implemented. Teachers and administrators who agree to develop and implement innovative experimental programs for a school year commitment or any part of a school year must obtain prior acknowledgement from the building Administration, Superintendent and the SSLTA Executive Committee and shall release the Board, Administration and Sheffield- Sheffield Lake Teachers Association from the enforcement of the Agreement provision waived through their written consent. The Board and the SSLTA shall keep the waiver on file. Should the Sheffield Lake Teachers Association Executive Committee or the Superintendent decline approval, a rationale for such a decision shall be placed in writing.
EXPERIMENTAL PROGRAMSThe parties agree that the contract may be amended to allow unique and innovative programs and provides the flexibility with which to try new methods to improve student achievement. Special grants and experimental programs will normally conform to the terms of the teacher labor agreement governing compensation, benefits and other working conditions. Exceptions may be allowed in specific instances with agreement from both Federation and the District. When it is determined that an exception to the terms of the labor agreement is warranted, the District and Federation will grant waivers as necessary that are specific to the program or circumstance and will not modify the remaining provisions of this agreement. Requests for waivers should be submitted to the District and the Federation during the grant writing process and prior to the final submission of the grant.

Xxxx Elementary School in an effort to improve student performance. 27.5 The School Board and the Association agree to adopt an Experimental Program for Xxxxx X. Xxxx Elementary School for the 2010-2013 school years upon approval of the SIG grant. Should the grant funding not cover the following provisions, the program will not be implemented unless the parties agree to a new funding source. The Program will not reduce any employee right under the contract and shall add the following additional components for assessing teacher performance, differentiated pay, recruitment/retention bonuses, and pay for performance.

EXPERIMENTAL PROGRAMSThe Employer and the Union recognize that from time to time the requirements of staffing and operating a nursing home may, due to circumstances beyond anyone's control, become burdensome to employees. To this end, the Employer may, with notice sent to the Union within twenty‐four (24) hours, in situations where it is necessary to maintain the efficient operation of the facility, offer premium or overtime pay to employees who volunteer to assume additional hours or responsibilities. The length of this premium will be based on the needs but must be implemented in a fair and equitable manner. The Employer may also initiate incentive award programs with the approval of the Union, to encourage or reward employees. The discontinuance of these programs must be mutually agreed to between the Union and the Employer. Any experimental programs implemented above shall not conflict with and must be in addition to the provisions of the Agreement. All such programs must be applied to eligible employees in a fair and equitable fashion. The Union shall not unreasonably deny the approval of the implementation of these programs.
EXPERIMENTAL PROGRAMSThe Employer and the Union recognize that from time to time the requirements of staffing and operating a nursing home may, due to circumstances beyond anyone's control, become burdensome to employees. To this end, the Employer may, from time to time, in situations where it is necessary to maintain the efficient operation of the facility, offer premiums or overtime pay to employees who assume additional hours or responsibilities. It is understood that this is intended as a short-term solution, and may be discontinued by the Employer, when the Employer deems it no longer necessary. Similarly, the Employer reserves the right to initiate and discontinue incentive award programs to encourage and/or reward employees. Any such programs will be applied to eligible employees in an equitable and nondiscriminatory fashion, and on the basis of departmental seniority, if applicable. The introduction of such programs is a proper subject for discussion in Labor-Management meetings. Such programs are not to replace or conflict with provisions of the Collective Bargaining Agreement.
EXPERIMENTAL PROGRAMSThe Board may utilize the services of non-bargaining unit instructors to provide additional instructional opportunities to the District’s students, including but not limited to on-site programs provided through career/technical schools. These programs shall be referred to as “experimental programs” and subject to the following guidelines: 5.19.1 For experimental programs engaged through Polaris Career Center, the Superintendent shall provide notice of the experimental program to NOEA Leadership prior to implementation of the program. In all other proposed situations, the Superintendent shall secure approval of the NOEA Leadership prior to the implementation of the program. 5.19.2 The experimental program shall not be a class currently taught by a bargaining unit member. 5.19.3 The maximum length of any specific experimental program shall not exceed two school years, unless mutually agreed to by the parties. 5.19.4 Upon the District’s determination that the program will become an ongoing offering (in no event later than two school years), the District will post the instructor position consistent with the collective bargaining agreement. If after posting the position the district is unable to find a qualified bargaining unit member to continue the experimental program, then the NOEA leadership may extend approval to continue the program on a year to year basis until a qualified applicant can be found. 5.19.5 Unless filled by a bargaining unit member under 5.19.4 above, instructors of an experimental program shall not be governed by this collective bargaining agreement and specifically shall have no rights to “bump” any bargaining unit member in the event of a reduction in force.
EXPERIMENTAL PROGRAMS. A. The Sandusky Board of Education shall take no action to comply with NO Child Left Behind Act of 2001 that affects the terms and conditions of the employment of bargaining unit members without negotiating those actions.
