Sick Leave Pool. In accordance with the following provisions, a faculty member may elect to pool accrued sick leave for disbursement to any participating faculty member who needs sick leave time in excess of the amount of his accrued sick leave: A. The Office of Human Resources shall have the authority to administer and implement the Sick Leave Pool for faculty members in accordance with the provisions of Article 13 of this Agreement and the laws of the State of Florida. The decisions of Human Resources shall be final. B. A faculty member may participate in the Sick Leave Pool on a voluntary basis. C. A faculty member shall be eligible for participation in the Sick Leave Pool after one year of employment with the College, provided the faculty member has accrued a minimum of twelve (12) days of unused sick leave. D. Each day of sick leave that a faculty member contributes to the Sick Leave Pool will be deducted from the contributing faculty member’s accrued sick leave balance. E. Each participating faculty member shall make an equal contribution to the Sick Leave Pool. F. Each participating faculty member shall make an initial contribution of four (4) days of accrued sick leave to the Sick Leave Pool. No additional contributions to the Sick Leave Pool will be required unless replenishment is needed for the Sick Leave Pool. If the number of days of accrued sick leave in the Sick Leave Pool is reduced to twenty-five (25) days, all participants shall be assessed with the same number of days as is necessary to replenish the Sick Leave Pool to a minimum of two hundred (200) days. G. A faculty member shall have an opportunity to enroll as a member of the Sick Leave Pool during the annual enrollment period, which shall occur during the first sixty (60) calendar days of the Fall Term each year, and shall make the four (4)- day contribution required by paragraph (F) above, or such greater contribution in excess of the four (4) days to the same extent all other members are contributing in order to replenish the Sick Leave Pool. A faculty member is not eligible to join the Sick Leave Pool while on sick leave. H. To utilize sick leave from the Sick Leave Pool, a participating faculty member must use the sick leave for a personal illness, accident or injury. I. A participating faculty member shall be eligible to use sick leave from Sick Leave Pool after his accrued sick leave and vacation leave have been depleted and the faculty member has used five (5) days of personal leave without pay for a personal illness or injury. K. L. If a participating faculty member elects no longer to participate in the Sick Leave Pool, the faculty member shall not be eligible to withdraw any sick leave days contributed to the Sick Leave Pool, nor be eligible to draw from the Sick Leave Pool in the future. M. After using three (3) draws of any amount up to the maximum of 25 days per draw, the faculty member will have to reapply to the Faculty Sick Leave Pool. Sick Leave Pool. In accordance Each officer shall accumulate 120 hours of sick leave, with pay, per calendar year. No Officer shall be eligible to draw sick leave pool days until one (1) of his sick days is credited to the pool. Upon completion of the initial two-month period of employment after graduation from the Academy, each Officer shall have 12 hours of sick leave credited to the pool. In the event of separation from employment prior to completion of the probationary period, the City may adjust the pool for any sick leave hours not actually earned by the contributing probationary Officer. When an Officer retires or dies, any sick leave accumulated by the Officer that would have otherwise been forfeited shall be credited to the sick leave pool. The Chief of Police and the President of the Association shall each appoint an equal amount of his accrued sick leave:
A. The Office of Human Resources shall have the authority officers to a committee in rank to administer the sick leave pool. The Committee shall then elect a chairman. The resulting vacancy will be filled by the opposite appointing officer from that receiving the chairmanship. Example: If the Chief of Police appointee is elected chairman, the Association President shall appoint for the created vacancy. The Chief of Police will select one Sergeant, one Detective and implement one Patrol Officer. The Association President will select one Detective and two Patrol Officers. In cases where an officer applies for sick leave pool benefits and holds a rank higher than sergeant, the Sick Leave Pool for faculty members in accordance with the provisions of Article 13 of this Agreement Chief and the laws President of the State Association will each appoint one person of Floridarank equal to or higher than held by the requesting Officer. All committee members shall be appointed on or before October 1 of each year and shall serve one-year terms. Any vacancies occurring during the course of the term shall be filled within twenty-one (21) calendar days. No person shall be allowed to serve more than one (1) consecutive term. The decisions of Human Resources City shall indemnify, defend, and hold harmless each committee member. The following requirements determine when a committee may consider when sick leave pool hours may be drawn. A decision by the committee shall be final.
B. A faculty member A. Officers may participate be considered for sick leave pool hours after taking off 120 consecutive working hours of continuous non-job-related illness or injury. The 120 consecutive working hours used for eligibility shall be submitted as a leave request by the Officer from his own accumulated sick leave and will not be refundable by the Committee or otherwise. The Department shall reimburse the Officer, from the hours in the sick leave pool, for any type of leave hours used in excess of the 120 consecutive working hours, if reimbursement is approved by the Sick Leave Pool on Committee.
B. No officer shall be permitted to use more than 1440 pool hours for a voluntary basissingle illness or injury.
C. A faculty member shall Pool hours may not be eligible used for participation injuries or illnesses sustained in the Sick Leave Pool after one year line of employment with the College, provided the faculty member has accrued a minimum of twelve (12) days of unused sick leaveduty.
D. Each day The number of hours in the pool shall be solely for the benefit of officers with extended injuries or illnesses, and such hours shall not revert to the accumulated sick leave of individual officers.
E. Pool time may only be used for disability, which is defined as a non-job-related injury or illness, which prevents an Officer from fully performing assigned duties in all major divisions of the Department.
X. The Committee Chairman may at any time or at the request of the Chief of Police reconvene the Committee for further consideration should evidence come forward that would affect the outcome of a faculty member contributes Committee decision after a decision has been reached. The Committee by majority vote may extend, reduce, approve, cancel, or deny a pool usage, as the evidence requires.
G. Officers desiring consideration for pool usage may be required to submit to medical examination by a City doctor and may be required to produce medical records, doctor's orders, and any other material necessary to render a decision by the committee.
X. Upon any Officer being absent from duty 18-work weeks as a result of a single illness or injury, the Chief may require the Officer to submit to a medical examination to determine whether the officer is permanently disabled. When it is determined that an Officer is permanently disabled, the Chief shall be entitled to terminate or retire the officer, whichever is applicable, according to law existing.
I. Officers applying to the Sick Leave Pool will be deducted from the contributing faculty member’s accrued sick leave balance.
E. Each participating faculty member shall make an equal contribution to the Sick Leave Pool.
F. Each participating faculty member shall make an initial contribution Committee for reimbursement of four (4) days of accrued sick leave to the Sick Leave Pool. No additional contributions to the Sick Leave Pool will be required unless replenishment is needed for the Sick Leave Pool. A faculty member is not eligible to join the Sick Leave Pool while on sick leave.
H. To utilize sick leave from the Sick Leave Pool, a participating faculty member must use the sick leave for a personal illness, accident or injury.
I. A participating faculty member shall be eligible to use sick leave from Sick Leave Pool after his accrued sick leave and vacation leave have been depleted and the faculty member has used five (5) days of personal leave without pay for a personal illness or injury.

Sick Leave Pool. The Administration and the UFF/BC agree to the formation of a sick leave pool effective January 1,1990. The following procedures shall apply to the use of the sick leave pool.
A. Membership
1. Participation in the pool shall be voluntary at all times.

The pool shall be considered depleted when the total number of credits in the pool is 30 days or fewer. The pool shall not be replenished more than 2 times in any 12-month period.
B. Utilization of Pool
1. No additional Use of sick leave pool credits is limited to the Faculty member's personal illness, accident, or injury.
2. Faculty members must have been absent from scheduled duty days for a minimum of 20 duty days, and must have exhausted all accrued sick and vacation leave before being eligible to apply for sick leave pool credits.
3. A Faculty member may apply for a maximum of 20 days credit at any one time. A maximum of 40 days may be granted in any 12-month period to an individual Faculty member.
4. Participating Faculty members may resign from the pool at any time. Upon resignation from the pool or from the College, all contributions to the pool and rights to receive leave credits from the pool shall be forfeited.
5. Alleged abuse of the pool shall be investigated and on a finding of wrongdoing, the Faculty member shall repay all of the sick leave credits wrongfully drawn from the pool. Such abuse could also lead to appropriate disciplinary action against the Faculty member.
6. Applications to join the sick leave pool and application for the use of sick leave pool credits shall be made to the Sick Leave Pool will be required unless replenishment is needed for the Sick Leave PoolCommittee. An employee so situated shall be eligible to use up to a maximum of sixty (60) days, in 20 day increments, from the pool within a twelve month period and vacation leave have been depleted and the faculty member has used only for approved absences of five (5) days of personal leave without pay for a personal illness continuous workdays or injurymore.

3. The Sick Leave Pool. Pool shall be administered as follows:
a. A faculty member is not eligible teacher whose sick leave accumulation has been exhausted may apply to join the Sick Leave Pool while on sick leave.
H. To utilize sick leave from the Sick Leave PoolCommittee, a participating faculty member must use the sick leave for a personal illness, accident or injury.
I. A participating faculty member shall be eligible to use sick leave from Sick Leave Pool after his accrued sick leave and vacation leave have been depleted and the faculty member has used such Committee consisting of five (5) members of the Association appointed by its President. I. A participating faculty member including the current year of employment; but in no event, shall the accumulative entitlement in the sick leave exceed "eighty" days for each said employee. Accrued sick leave is available at the beginning of the contract year. Sick leave is renewable each year for certified staff regardless of prior usage. The sick leave bank shall contain 500 days at the start of each school year. Once 500 days have been used from the sick leave bank, by all employees, in any school year, no further leave shall be eligible to use granted from the sick leave from Sick Leave Pool after his accrued bank. Days in the sick leave bank are not applicable to family illness and vacation shall cover absences for the illness of the employee only. Further use of sick leave days shall terminate at the time a physician states the employee is able to return to work. Sick Leave Pool. In accordance with 10.1 The Committee and the following provisions, Association agree to establish a faculty member may elect to pool accrued sick leave for disbursement to any participating faculty member who needs sick leave time in excess of the amount of his accrued sick leave:
A. The Office of Human Resources shall have the authority to administer and implement the Sick Leave Pool for faculty the members in accordance with of the provisions of Article 13 bargaining unit which shall be administered by the Superintendent, or his/her designee, according to the following guidelines:
A. Each secretary may voluntarily become a member of this Agreement and the laws of the State of Florida. The decisions of Human Resources shall be finalSick Leave Pool for Secretaries.
B. A faculty member may participate As requirement of membership in the Sick Leave Pool each participating member shall voluntarily donate one day per year from their own sick leave entitlement to the pool which shall be effective on the first day of school of a voluntary basisschool year. After five (5) years of membership in the pool, members will no longer need to donate annually unless the pool of available days drop below 100.
C. A faculty member An individual shall be eligible for participation not lose membership in the Sick Leave Pool after one year pool should that participating member be out for an extended period of employment with the College, provided the faculty member has accrued a minimum of twelve (12) days of unused sick leavetime.
D. Each day of sick leave that pool member may receive a faculty member contributes Sick Leave Pool benefit of up to a maximum of ten days in a school year. All requests for access to the Sick Leave Pool must be approved by the Association’s Officers before submitting the Sick Leave Pool request form to the Business Administrator. The Business Administrator will be deducted from submit the contributing faculty member’s accrued Sick Leave Request to the Superintendent for approval, both the Superintendent and the Association Officers must approve the sick leave balancerequest.
E. Each participating faculty member shall make an equal contribution The existence of the Sick Leave Pool is a privilege rather than a convenience, therefore, days will be granted from the Pool only in cases of serious injury or illness verified by a physician’s certificate which demonstrates a genuine disability and includes clarification of what the patient can do or cannot do in relation to assigned duties.
F. The use of the Sick Leave Pool is limited to one hundred eighty-two days maximum per illness, and limited to employees who have been employed five years or more in the Methuen Public Schools. Employees who have been employed less than one year, are not eligible for days from the Sick Leave Pool. Employees who have been employed more than one, but less than five years, will be entitled to only fifty days from the Sick Leave Pool.
F. G. Each party agrees to allow the emergency granting of ten (10) days from the sick leave pool if approved the chair/co-chairs and the Superintendent in order to not interrupt paychecks for an individual. Once the member has submitted all the proper documentation, the member can apply for more sick leave pool days should the member show a need.
H. All participating faculty members shall sign an affidavit indicating their desire to join the pool. Continued membership from year to year shall be automatically assumed as long as the participating member is employed as a member of the bargaining unit. A participating member shall make sign an initial contribution affidavit indicating their termination of four (4) days of accrued sick leave to the Sick Leave Pool. No additional contributions to the Sick Leave Pool will be required unless replenishment is needed for the Sick Leave Pool. If the number of days of accrued sick leave membership in the Sick Leave Pool is reduced to twenty-five (25) days, all participants shall if the individual will be assessed with the same number of days as is necessary to replenish the Sick Leave Pool to a minimum of two hundred (200) days.
G. A faculty member shall have an opportunity to enroll continuing as a member of the Sick Leave Pool during the annual enrollment period, which shall occur during the first sixty (60) calendar days of the Fall Term each year, and shall make the four (4)- day contribution required by paragraph (F) above, or such greater contribution in excess of the four (4) days bargaining unit but desires not to the same extent all other members are contributing in order to replenish the Sick Leave Pool. A faculty member is not eligible to join the Sick Leave Pool while on sick leave.
H. To utilize sick leave from the Sick Leave Pool, a participating faculty member must use the sick leave for a personal illness, accident or injury.
I. A participating faculty member shall be eligible to use sick leave from Sick Leave Pool after his accrued sick leave and vacation leave have been depleted and the faculty member has used five (5) days of personal leave without pay for a personal illness or injury.
J. Following review and approval by the Office of Human Resources, the maximum number of days that a participating faculty member may draw from the Sick Leave Pool shall be three increments of up to twenty-five (25) days each.
K. Except as provided in paragraph (M) below, a participating faculty member who uses sick leave from the Sick Leave Pool shall not be required to re-contribute the sick leave used, except for replenishment as described in paragraph (G) above.
L. If a participating faculty member elects no longer to participate continue voluntary participation in the Sick Leave Pool, the faculty member shall not be eligible to withdraw any sick leave days contributed to the .
I. Procedures:
a. Obtain a Sick Leave Pool, nor Pool Request Form from the personnel office (Business Administrator). Fill out this form providing all information requested and attach physician’s certificate which explains: (1) the nature of the illness and (2) the expected number of days requested to be eligible to draw from out of work.
b. Return the Sick Leave Pool Request Form and the physician’s certificate to the personnel office (Business Administrator) with a copy to the Methuen Educational Secretaries Association. A second medical certificate may be requested form a physician approved by the Methuen Public Schools.
c. A doctor’s certificate may be required upon return from an absence of three or more days. The employee must notify his/her Supervisor on or before the first day of the absence informing the Supervisor as closely as possible when the employee expects to return to work. The employee is expected to keep his/her Supervisor informed during his/her absence as to the expected duration of such absence. If deemed to be in the futurebest interest of the Superintendent or his/her designee, a physical examination of the employee may be required, such examination to be administered by a Committee selected physician and without charge to the employee.
M. After using three (3) draws d. An employee shall not suffer any loss of sick leave accumulation during any amount up period of absence from work due to any injury arising out of and in the maximum course of 25 days per draw, the faculty member will have to reapply to the Faculty Sick Leave Pool. To be accepted, the faculty member must have performance of assigned duties for a minimum period of one (1) year’s continued employment with calendar year from the College, twelve (12) accrued date of said injury. It is understood that while there shall be no loss of sick leave days and contribute four (4) sick accumulation during said period, there shall be no additional accumulation of said leave days to the Sick Leave Pool during the enrollment said period.

2. The employee who cancels membership in the sick leave pool shall not be eligible to withdraw the days of sick leave the employee has contributed to the pool.
G. A participating faculty member employee shall not be eligible to use sick leave days from Sick Leave Pool after his accrued the pool until all of the employee’s sick leave has been depleted. An employee so situated shall be eligible to use up to a maximum of sixty (60) days, in 20-day increments, from the pool within a twelve-month period and vacation leave have been depleted and the faculty member has used only for approved absences of five (5) days of personal leave without pay for a personal illness continuous workdays or injurymore.

J. Abuse of the futureuse of the sick leave pool may be investigated and on a finding of wrongdoing, the employee may be required to repay any or all of the employee’s sick leave credits drawn from the sick leave pool at the employee’s regular daily rate of pay. Rules adopted for the administration of this program shall provide for the investigation of the use of sick leave.

Should a personal illness teacher require additional days at the commencement of the following year, he or injury.
J. Following review and approval by the Office of Human Resources, the maximum number of days that a participating faculty member she may draw apply. Application to borrow from the Sick Leave Pool will be made to the Trustees. A teacher who is injured in a non-job related accident which is compensated for by insurance, who is on unpaid leave, or who is entitled to disability retirement may not participate in the sick leave pool. If an approval of application is not achieved by the sick pool trustees, or an applicant is dissatisfied with the decision of the Sick Leave Bank Trustees, an appeal can be made by the applicant to a review board composed of two members appointed by the Superintendent, two members appointed by the President of the Teachers’ Association and one member acceptable to both the Superintendent and the STA president. The decision of the review Board shall be three increments of up to twentyfinal, binding and non-five (25) days eachgrievable.
K. Except as provided 4. When the total number of days accumulated in paragraph (M) below, a participating faculty member who uses sick leave from the Sick Leave Pool exceeds one thousand two hundred (1,200), yearly deductions from teachers shall not be required to re-contribute discontinued until the sick leave used, except for replenishment as described in paragraph (G) above.
L. If a participating faculty member elects no longer to participate total number of days in the Sick Leave Pool, pool falls below five hundred (500). New employees and/or new enrollees who wish to join must contribute required days as per seven (7) regardless of time limits on total accumulated days
5. New teachers may elect to join the faculty member shall not be eligible to withdraw any sick leave days contributed to the Sick Leave Pool, nor be eligible to draw from the Sick Leave Pool in the future.
M. After using three (3) draws of any amount up to the maximum of 25 days per draw, the faculty member will have to reapply to the Faculty Sick Leave Pool. To be accepted, the faculty member must have a minimum of one (1) year’s continued employment with the College, twelve (12) accrued sick leave days and contribute four (4) sick leave days to the Sick Leave Pool during the enrollment periodthirty (30) day time period following their initial start date in the District.
