Solicitors Fees. If a proceeding is brought for the enforcement of this Agreement or because of any alleged or actual dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the prevailing party shall be entitled to recover reasonable solicitors’ fees and other costs and expenses incurred in such action or proceeding in addition to any other relief to which such party may be entitled.
Solicitors Fees. Solicitor's fees and disbursements arising out of any dispute which may develop in connection with this Agreement and which is arbitrated or otherwise litigated or appealed shall be recoverable as damages by the ultimate prevailing party in amounts deemed to be reasonable by the arbitrator or the court, as the case may be.
Solicitors Fees. If the Lessor at any time incurs reasonable legal fees and costs in instituting or prosecuting any action or proceedings based upon any default of the Lessee under this Lease, all such fees and costs (on a solicitor/client basis) shall be payable by the Lessee to the Lessor and be recoverable by the latter as Rent. All such fees and costs shall be payable by the Lessee to the Lessor upon demand for payment being made.
Solicitors Fees. Should it become necessary to take any action to collect any amount invoiced to the Client under this Section or otherwise enforce the terms of this Agreement, Client agrees to pay our actual and reasonable solicitor's fees and all reasonable costs of collection including, but not limited to any solicitor's fees associated with obtaining, enforcing or collecting upon any final, non- appealable judgment against Client issued by a court of competent jurisdiction.
Solicitors Fees. (i) Should it become necessary to take action in order to collect any amount invoiced to the Client under this paragraph or otherWise enforce the terms of this Agreement, Client agrees to pay Hyve's actual and reasonable solicitor's fees and all reasonable costs of collection including, but not limited to, any solicitor's fees associated With obtaining, enforcing or collecting upon any final, non- appealable judgment against Client issued by a court of competent jurisdiction.
(ii) Should it become necessary for Hyve to defend against or respond to any third-party claims under the Intellectual Property LaWs of the European Union, the United Kingdom, the United States, or a foreign country, or any treaties to Which the Parties to this Agreement is subject, Client shall pay Hyve's actual and reasonable solicitor's fees and costs associated With such response or defence, as the case may be, but only to the extent that such third-party claims arise out of any actions undertaken by Client.
Solicitors Fees. If any action is brought to enforce or interpret the provisions of this Agreement, the prevailing party will be entitled to reasonable Solicitor’s fees in addition to any other relief to which the party may be entitled.
Solicitors Fees. In the event any Party shall commence any claims, actions, formal legal action, or arbitration to interpret and/or enforce any of the terms and conditions of this Agreement, or relating in any way to this Agreement, including without limitation asserted breaches of representations and warranties, the prevailing party in any such action or proceeding shall be entitled to recover, in addition to all other available relief, its reasonable solicitors' fees and costs incurred in connection therewith, including solicitors' fees incurred on appeal.
Solicitors Fees. In the event it becomes necessary for Seller to enforce the terms and conditions of the Purchase Order or this Agreement by litigation or otherwise, or to defend itself in any controversy, litigation, claim, demand or cause of action arising out of or as a result of the Purchase Order, this Agreement or the Products, and if Seller is the substantially prevailing party in said controversy, litigation, claim, demand or cause of action, then Seller shall be entitled to recover, in addition to any other relief gran- xxx or damages assessed, its reasonable professional fees, expert witness fees, costs and expenses of litigation.
Solicitors Fees. In the event that a suit or action is instituted by the City to enforce compliance with this agreement, the City shall be entitled, in addition to costs allowable by statute, to such additional sum as the court may adjudge as reasonable solicitor's fees to be allowed in the suit or action.
Solicitors Fees. The TC and or Employer is entitled to recover Solicitor's fees in any legal proceeding brought under or in connection and for the purpose of enforcing this guaranty.
