Common use of SPECIFIED HOLIDAYS Clause in Contracts

SPECIFIED HOLIDAYS. 14.1 All permanent and temporary employees covered by this agreement are entitled to twelve (12) Specified Holidays with pay, regardless of the day on which the Holiday occurs, provided they have worked their regular shift on their regular work day preceding such Holiday and the regular work day succeeding such Holiday, or has obtained authorized leave of absence for such regular work days. Provided also, that a permanent and temporary employee works on a Specified Holiday if they are scheduled to do so. Said Specified Holidays shall be: New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day. Half (1/2) day and half Christmas Eve (1/2) day New Year's Eve, when Christmas Eve or New Year's Eve fall on a weekday, i.e. Monday through Friday. 1/2 day will be defined as commencing at the halfway point of the employee's shift, and will apply to employees working day shift only. See Appendix D. An additional paid Holiday called a Floater Holiday shall be granted upon mutual agreement of an employee and Department Manager or Nominee. The following qualifications will apply to the Floater Holiday. 1) It must be taken during the calendar year and may be used in two (2) four hour blocks with such approval subject to operational requirements. 2) Failure to take the Floater forfeits all entitlements to the Holiday. 3) It will be on a first request basis. 4) The Floater Holiday will not apply to permanent or temporary employees with less than six (6) months continuous service. 14.2 In the event such employee is absent from their regular shift before or after such Holiday, and presents a reasonable explanation to the Corporation for such absence, they shall be paid. 14.3 When Specified Holidays occur on Saturday and/or Sunday, those employees whose work week is scheduled on a six (6) or seven (7) consecutive day basis may have their work period rescheduled by the Corporation in a manner mutually agreeable to both Parties. Such shift schedule change will be discussed with the Union prior to implementation. 14.4 Stat days earned as a result of working a specified holiday during the period from Christmas Day of one year to November 30 of the following year shall be taken in the same time period. If the stat days are not taken, the time will be paid out immediately following November 30. 14.5 Whenever changes occur under Clause 14.3, overtime premiums will be paid for work performed on the actual Specified Holiday and work performed on the substituted stat days shall be paid on a straight time basis. 14.6 When an employee is receiving overtime premium rate for work on a Specified Holiday the premium will be applied only to base rates. When shift, wing, lead hand or any other premiums apply, they will not be subject to overtime premium rates. 14.7 This Article dealing with Specified Holidays does not apply to employees who are in receipt of Long Term Disability benefits.

The option set out in the above paragraph shall be exercised only with the concurrence of the affected employee. The allowance for each week of vacation will apply be determined by multiplying the average hourly earnings (exclusive of overtime premium and shift bonus) by the number of hours in the employee’s regular weekly schedule, not to exceed the minimum number of hours per week which the employee may be required to work before an overtime premium becomes payable. Average hourly earnings will be obtained from the second pay period prior to the Floater Holidayvacation. It is not to postpone the vacation period or any part thereof from one year to another. Such shift schedule change will be discussed with the Union prior to implementation. 14.4 Stat days earned as a result of working a specified holiday during the period from Christmas Day of one year to November 30 of the following year shall be taken in the same time period. If the stat days are not taken, the time will be paid out immediately following November 30. 14.5 Whenever changes occur under Clause 14.3, overtime premiums will be paid for work performed on the actual Specified Holiday and work performed on the substituted stat days shall be paid on a straight time basis. 14.6 When an employee is receiving overtime premium rate for work on a Specified Holiday the premium will be applied only to base rates. When shift, wing, lead hand or any other premiums apply, they will not be subject to overtime premium rates. 14.7 13.2 This Article dealing with Specified Holidays does not apply to employees who are in receipt of Long Term Disability benefits. 13.3 Employees who have been absent and without pay from the Region for any reason for more than thirty (30) calendar days shall not qualify for future specified holidays until their return to active employment.

SPECIFIED HOLIDAYS. 14.1 15.1 All permanent and temporary employees covered by this agreement are shall be entitled to twelve (12) paid Specified Holidays with payHolidays, regardless of the day on which the Holiday occurs, provided they have worked their providing such employee has been at work on the regular shift on their regular work working day preceding such the Holiday and the regular work working day succeeding such the Holiday, or has obtained authorized leave of absence for such regular work days. Provided also, also that a permanent and temporary an employee works on a Specified Holiday if they are he/she is scheduled to do so. Said An employee who is absent on the day before or the day after such Holiday and presents a reasonable excuse for such absence shall be paid. The Specified Holidays shall beare as follows: ** New Year's ’s Day, ; Family Day, Good Friday, ; Easter Monday, ; Victoria Day, ; Canada Day, ; Civic Holiday, ; Labour Day, ; Thanksgiving Day, ; Remembrance Day, ; Christmas Day and Day; Boxing Day. Half In addition to the above Specified Holidays, a half (1/2) day and half Christmas Eve and a half (1/2) day New Year's Eve, ’s Eve will be granted when Christmas Eve or New Year's ’s Eve fall on a weekday, i.e. between Monday through and Friday. 1/2 day for this purpose will be defined as commencing at the halfway 1/2 way point of the employee's shift, shift and will shall apply to employees working day shift only. See Appendix D. An Employees may be required to modify their start time to ensure that minimal coverage is maintained until noon, at the discretion of the Corporation. In addition to the Specified Holidays, an additional paid Holiday holiday called a Floater Floating Holiday shall be granted upon mutual agreement of an the employee and his/her Department Manager Head or the Department Head’s Nominee. The following qualifications will apply to the Floater Floating Holiday.: (1) It must be taken during the calendar year and may be used in two (2) four hour blocks with such approval subject to operational requirementsyear. (2) Failure to take the Floater Floating Holiday forfeits all entitlements to the Holiday. (3) It Requests for a floating holiday may be submitted by an employee any time in the calendar year, however requests for dates from June 1 to December 31st will not be approved until the vacation schedule has been posted in accordance with clause 16.6. All requests for floating holidays will be scheduled on a first request basis. SPECIFIED HOLIDAYS. 14.1 9.01 The company agrees to pay an employee, as provided under Section 9.03 below, for the following statutory holidays and other specified days listed in this Section (the “Specified Holidays”) without requiring the employee to render service. For the application of the Sections of this Article, where a Specified Holiday occurs on a Saturday, it shall be observed on the preceding Friday, and where a Specified Holiday occurs on a Sunday, it shall be observed on the following Monday: New Year’s Day Victoria Day Labour Day Boxing Day (December 26) Family Day Canada Day Thanksgiving Day Good Friday Civic Holiday Christmas Day July 2 July 2 July 4 July 3 September 3 September 2 Employees shall be permitted to observe one (1) additional day per calendar year as a Specified Holiday on a date mutually agreed to by the employee and the Supervisor or, failing such agreement having been reached by October 1 of each year, on a date scheduled by the Company. In the event of a lay-off affecting fifty percent (50%) or more of the workforce, the Specified Holidays (floaters) can be moved to another date mutually agreed upon between the Union and the Company within fourteen (14) calendar days of the original date of the Specified Holiday. The Specified Holiday shall be moved at the new agreed upon date for all employees on lay-off. 9.02 An employee shall qualify for holiday pay if: All permanent and temporary employees covered by this agreement are entitled to twelve (12) Specified Holidays with payAgreement, regardless of shall be paid their regular wages for the holidays above, providing the employee is not absent from work either on the day on which immediately preceding or the Holiday occurs, provided they have worked their regular shift on their regular work day preceding such Holiday and immediately following the regular holiday. The Company may require medical certificate from the employee in case of absences due to illness or accident. In such Holiday, or has obtained authorized leave event the Company shall reimburse the employee for the full cost of absence obtaining the medical certificate. The Company may also require a medical certificate attesting to the employee’s fitness to return to work. In such event the company shall reimburse the employee for such regular work days. Provided also, that a permanent and temporary employee works on a Specified Holiday if they are scheduled to do so. Said Specified Holidays shall be: New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day. Half (1/2) day and half Christmas Eve (1/2) day New Year's Eve, when Christmas Eve or New Year's Eve fall on a weekday, i.e. Monday through Friday. 1/2 day the full cost of obtaining the medical certificate. 9.03 The day’s pay will be defined as commencing at calculated on the halfway point basis of the employee's shift, and will apply to employees working day shift only’s hourly wage rate multiplied by the number of hours in the employee’s standard workday.
