SPECIFIED HOLIDAYS. 11.01 For the purposes of this Article the following shall be specified as holidays under this Agreement and "holiday" means: New Year's Day Family Day Good Friday Easter Monday Victoria Day Canada Day Simcoe Day Labour Day Thanksgiving Day Christmas Day Boxing Day and the half day immediately before Christmas Day and the half day immediately before New Year's Day, unless any such days are school days, or such day as may be established as a holiday in lieu of any of said days by statute, statutory regulation, proclamation or similar authority or by the Board and any named holiday added to The Education Act of Ontario or to its regulations and enjoyed by the Board's students. If the Board determines that where a holiday falls on a non-working day that a working day not later than the next annual vacation of the employee shall be the holiday in lieu thereof, then for the purpose of this Agreement such substituted day shall be regarded as the employee's holiday notwithstanding the foregoing. 11.02 A specified holiday shall be considered as commencing at midnight of the day preceding the holiday and ending 12 midnight on the holiday. 11.03 If an employee is required to work on any specified holiday, the employee shall be entitled to receive twice the employee's prorated salary for such work in addition to any holiday pay to which the employee may be entitled. 11.04 An employee shall be entitled to each of the holidays without any loss in pay: (a) if the employee was not absent from work on the employee's last scheduled work day or shift immediately preceding or the employee's first scheduled work day or shift immediately following such holiday unless such absence was because of an illness or injury and is supported by a physician's certificate to that effect; (b) if the employee has been instructed to report for work on such holiday and does so; (c) if the employee was not on strike; or (d) if the employee was not on a leave of absence without pay for a period of time in excess of ten (10) working days that encompasses the holiday; provided the employee shall not be paid if the employee has not worked in the thirty (30) day period immediately preceding such holiday and is not receiving sick leave pay when such holiday occurs but if the employee is absent for more than such thirty (30) day period and is receiving sick leave pay the employee shall receive pay for such holiday. 11.05 If a holiday falls during an employee's vacation, the employee shall be entitled to an extra day off work with pay, as mutually agreed. 11.06 Notwithstanding the foregoing, school secretaries not required to work during the summer vacation period shall not be entitled to be paid for Simcoe Day.

7:02 For the application of the Sections of this Article, a specified holiday as listed above shall be observed on the day on which it occurs, except that if such days are school daysa holiday occurs on a Saturday it shall be observed on the preceding Friday and except, also, if such a holiday occurs on a Sunday it shall be observed on the following Monday.
7:03 An employee shall qualify for holiday pay under Section 7:01 above:
a) If he works a number of hours equivalent to five full shifts in the normal bi-weekly pay period in which the specified holiday is observed.
b) If he works one or more shifts in the pay period in which the holiday falls and has been unable to complete the required five full shifts referred to in subsection (a) above on account of a layoff due to work shortage or an absence due to verified illness in excess of the equivalent of four shifts in the pay period in which the specified holiday is observed.
c) If he is prevented from complying with the provisions of subsection 7:03 (c) as a result of the application of Section 13:04.
d) If he is a new employee, has complied with the provisions of 7:03 (a), and he commences work prior to the day of observance of the specified holiday.
e) If he is an employee recalled from layoff, he complies with the provisions of subsection 7:03 (c) and commences work prior to the day of observance of the specified holiday. This subsection (e) will not apply if the holiday is observed on the first day of the pay period and the employee commences work on the first normal working day following observance of the holiday.
7:04 The specified holiday pay as referred to in this Article will be calculated on the basis of the employee's hourly wage rate multiplied by the number of hours in the employee's standard work day.
7:05 Shift bonus for employees permanently on night shift will be included in calculating payment for the day on which such specified holiday is observed. A permanent night shift employee is an employee who, during the three-month period immediately prior to the pay period in which the specified holiday is observed, has not rotated to the day shift for one full week.
7:06 An employee required to work on the day on which the specified holiday is observed will receive overtime pay as shown in Article 6, in addition to the specified holiday pay.
7:07 If the specified holiday is observed during an employee's annual vacation, payment for such holiday will be made. Annual vacation, or such day as may be established as specified holidays in a holiday in lieu of any of said days by statutepay period, statutory regulation, proclamation or similar authority or by the Board and any named holiday added to The Education Act of Ontario or to its regulations and enjoyed by the Board's students. If the Board determines that where a holiday falls on a non-working day that a working day not later than the next annual vacation of the employee shall be the holiday in lieu thereof, then considered as worked time for the purpose of this Agreement such substituted day shall be regarded as the employee's holiday notwithstanding the foregoing.

(ii) Employees shall have the right of choosing to work or not to work on any of the above-mentioned specified holidays; subject of course to the Employer’s right to schedule and require Employees to work so as to ensure an adequate workforce to perform the required work.
18.02 Specified holiday pay will be computed on the basis of the normal scheduled shift hours and shall include any short-term disability benefit and/or workplace safety and insurance compensation benefit at an Employee’s regular straight time hourly rate.
18.03 In order to qualify for specified holiday pay, an Employee shall work his/her full scheduled shift on each of their scheduled shifts immediately preceding and immediately following the specified holiday concerned and the half day immediately before Christmas Day holiday if the Employee is scheduled to work and the half day immediately before New Year's Day, fails to unless any such days are school days, or such day as may be established as a holiday in lieu of any of said days by statute, statutory regulation, proclamation or similar authority or by the Board and any named holiday added absent due to The Education Act of Ontario or to its regulations and enjoyed by the Board's students. If the Board determines that where a holiday falls on a non-working day that a working day not later than the next annual vacation of the employee shall be the holiday in lieu thereof, then for the purpose of this Agreement such substituted day shall be regarded as the employee's holiday notwithstanding the foregoingreasonable cause.
