Common use of Step 4 Clause in Contracts

Step 4. (1) If a satisfactory decision has not been rendered, the Association may submit the grievance to binding arbitration within twenty (20) business days of the disposition at Step 2 or Step 3, whichever is appropriate. (2) If the parties cannot agree as to the arbitrator within ten (10) days of the decision to submit to arbitration, the arbitrator shall be selected by the American Arbitration Association in accordance with its voluntary labor arbitration rules. (3) The fees and expenses of the arbitrator shall be shared equally by the Board and Association. (4) The arbitrator shall not have the authority to interpret state or federal statute. The arbitrator shall not have the power to alter, add to, or to subtract from the terms of this Agreement. Both parties agree to be bound by the award of the arbitrator and agree that judgment thereon may be entered in any court of competent jurisdiction.
