Common use of Substance Abuse Program Clause in Contracts

Substance Abuse Program. Contractor shall require its prospective, safety sensitive employees who may be assigned to perform safety-sensitive duties related to the HTA’s Dial-A-Ride system to undergo pre-employment drug testing, consistent with HTA policies and any applicable state/federal laws. Safety sensitive employees shall also be subject to post-accident testing, probable cause testing, and random testing, as required by FTA 49 CFR Parts 653 and 654, Prevention of Prohibited Drug Use in Transit Operations and Prevention of Alcohol Misuse in Transit Operations. Such drug and alcohol tests will comply with Federal Transit Administration (FTA) regulations. If an employee fails a random, post-accident, or probable cause test, Contractor shall inform the HTA’s Dial-A-Ride Contract Administrator of the failure and of the actions taken within 24 hours of the event.
