Superseding Clause. This agreement supersedes any and all other agreements dealing with working conditions and terms and conditions of employment which are inconsistent with the terms of this agreement.
Superseding Clause. This Agreement shall supersede any current rules, regulations or policies of the Board, which shall be contrary to or inconsistent with its terms.
Superseding Clause. This Policy supersedes any prior policies adopted by the Board of Trustees regarding investment or securitization of Funds of Texas CLASS.
Superseding Clause. All of the terms and conditions of employment set forth in Article VI(B)(3) shall supersede and replace any sections of the Ohio Revised Code with which they are in conflict, including, but not limited to: Sections 3313.202; 3317.13; 3317.14; 3319.08; 3319.11; 3319.111;
Superseding Clause. Any inconsistency, ambiguity or conflict between: (1) the Suppliers quotation, proposal or offer; or (2) the General Terms and Conditions; or (3) any SOW; or (4) a separate agreement shall be resolved in the following order of precedence (with (i) having the highest priority): (i) separate agreement; (ii) SOW; (iii) the General Terms and Conditions; and (iv) the Supplier’s quotation, proposal or offer.
Superseding Clause. This provision shall supersede and replace any prior fee schedule and/or arrangement entered into between the Parties in connection with the receipt and or provision of services under the Agreement. Where any provision of this provision conflicts with any provision in the main body of the Agreement, the terms of this provision shall prevail.
Superseding Clause. This Codified and Restated Trust Agreement shall, on and as of August 22, 2024, supersede and replace the Original Trust Agreement dated as of October 1, 1968, and all amendments thereto contained in Supplemental Trust Agreements or recodifications which became effective on and prior to that date to the extent amendments contained therein were in definite form and had received the requisite bondholder consent. The terms and provisions of the Supplemental Trust Agreements pertaining to Bonds which remain Outstanding on the effective date hereof shall, except to the extent described in the preceding sentence, remain in full force and effect. Superseding Clause. 40.01 Consistent with Ohio Revised Code Chapter 4117, the parties intend that this Agreement shall supersede and replace in their entirety any and all provisions of the Ohio Revised Code, which are in conflict or are inconsistent with any provision of this Agreement, whether or not the provision is specifically enumerated herein.
Superseding Clause. This Amendment supersedes any and all other agreements, and/or resolutions dealing with the subject matter of the LULO insofar as this Amendment purports to amend paragraph 1 of the LULO, and any related provisions thereof in respect of the termination of the Lock-Up provisions thereof.
Superseding Clause. The terms and conditions of this First Amendment shall supersede, amend and modify all terms and conditions of the Lease. In the event of any conflict between the terms and conditions contained herein and the terms and conditions contained in the Lease, all terms and conditions contained in this First Amendment shall control. In all other respects, all terms and conditions of the Lease shall remain in full force and effect.
