Supervising Officer. 5.1 The functions, rights and powers conferred by this Contract upon the Council shall be exercised by the Supervising Officer as defined in the Conditions. The Contractor shall in no circumstances question the existence or extent of the authority of any person notified to the Contractor (whether orally or in writing) to be the Supervising Officer.

Supervising Officer. 3.1 The Company shall appoint a person to be the Supervising Officer for the purposes of the Contract and, subject to Condition 3.2, to carry out the functions of the Supervising Officer under the Contract. The Company shall notify the Consultant in writing of the appointment of the Supervising Officer (or of the appointment of any other person to succeed him). 3.2 The Company may from time to time delegate to any employee, agent, representative or sub-contractor of the Company any of his powers and/or functions under the Contract and shall notify the Consultant as to what powers and/or functions have been so delegated. For the purposes of the Contract, where the Supervising Officer has delegated its powers and/or functions to an employee, agent, representative or sub- contractor of the Company, any references in these Conditions to the Supervising Officer exercising any rights and/or discharging responsibilities under the Contract which have been delegated, shall be deemed to be references to the relevant employee, agent, representative or sub-contractor of the Company exercising such rights and/or discharging such responsibilities. 3.3 The Consultant shall comply with any and all reasonable and lawful instructions given by the Supervising Officer in respect of the performance of the Services and co-operate in good faith with the Supervising Officer in all matters under or in connection with the Contract.
Supervising Officer. MBC shall appoint a Supervising Officer who shall have power (such power to be delegated to any Officer of MBC as the Supervising Officer decides) to issue instructions to the KCC in accordance with the provisions contained in the Conditions of Contract and the Service Level Schedule for the satisfactory performance of the Management Services.

  • Hearing Officer The Hearing Officer shall be jointly selected by the parties within thirty (30) days of the execution of this contract and shall serve for a minimum of one (1) year from the date of selection. At that time the parties may choose to re-appoint the Hearing Officer or select a different Hearing Officer who will also serve for a minimum of one (1) year from date of selection.

  • EEO Officer The contractor will designate and make known to the contracting officers an EEO Officer who will have the responsibility for and must be capable of effectively administering and promoting an active EEO program and who must be assigned adequate authority and responsibility to do so.

  • PROJECT OFFICER The performance of the Contractor is subject to the review and approval of the County Project Officer, who will be appointed by the Director of the Arlington County department or agency requesting the Work under this Contract.

  • Compliance Officer Within 90 days after the Effective Date, Post Acute Medical shall appoint a Compliance Officer and shall maintain a Compliance Officer for the term of the CIA. The Compliance Officer shall be an employee and a member of senior management of Post Acute Medical, shall report directly to the Chief Executive Officer of Post Acute Medical, and shall not be or be subordinate to the General Counsel or Chief Financial Officer or have any responsibilities that involve acting in any capacity as legal counsel or supervising legal counsel functions for Post Acute Medical. The Compliance Officer shall be responsible for, without limitation: a. developing and implementing policies, procedures, and practices designed to ensure compliance with the requirements set forth in this CIA and with Federal health care program requirements;‌‌ b. making periodic (at least quarterly) reports regarding compliance matters directly to the Manager of Post Acute Medical, and shall be authorized to report on such matters to the Manager at any time. Written documentation of the Compliance Officer’s reports to the Manager shall be made available to OIG upon request; and c. monitoring the day-to-day compliance activities engaged in by Post Acute Medical as well as any reporting obligations created under this CIA. Any noncompliance job responsibilities of the Compliance Officer shall be limited and must not interfere with the Compliance Officer’s ability to perform the duties outlined in this CIA. Post Acute Medical shall report to OIG, in writing, any changes in the identity of the Compliance Officer, or any actions or changes that would affect the Compliance Officer’s ability to perform the duties necessary to meet the obligations in this CIA, within five days after such a change.

  • Chief Compliance Officer The Chief Compliance Officer of the Trust will be responsible for administering its compliance policies and procedures, shall have sufficient authority and independence within the organization to compel others to adhere to the compliance policies and procedures, shall report directly to the Board of Trustees, shall annually furnish a written report on the operation of the compliance policies and procedures to the Board of Trustees and shall perform such other duties as prescribed by the Board of Trustees.

  • President and Chief Executive Officer The president shall be the chief executive officer of the Trust, unless the Board of Trustees designates the chairman as chief executive officer. The chief executive officer shall see that all orders and resolutions of the Board of Trustees are carried into effect. The chief executive officer shall also be the chief administrative officer of the Trust and shall perform such other duties and have such other powers as the Board of Trustees may from time to time prescribe.
