Surrendering the Premises. Upon the Ending Date or the date the last extension Term, if any, ends, whichever is later, Tenant shall surrender the Premises to Landlord in the same broom clean condition that the Premises were in on the Beginning Date except for: (i) ordinary wear and tear; (ii) damage by the elements, fire, and other casualty unless Tenant would be required to repair under paragraph 3.03(a); (iii) condemnation; and (iv) alterations as permitted by this Lease unless consent was conditioned on their removal. On surrender Tenant shall remove from the Premises its personal property, trade fixtures, and any alterations required to be removed under paragraph 4.01 and repair any damage to the Premises caused by the removal. Any items not removed by Tenant as required above shall be considered abandoned. Landlord may dispose of abandoned items as Landlord chooses and bxxx Tenant for the cost of their disposal, minus any revenues received by Landlord for their disposal.

Surrendering the Premises. Tenant shall schedule its date(s) for vacating and moving out of the Premises, in writing, with Landlord in advance of the Termination Date and surrender the Premises to Landlord in a broom clean condition and otherwise in the same condition that existed immediately following the installation of the Tenant Improvements in the Premises, except for: (i) ordinary wear and tear; (ii) damage by the elements, fire, and other casualty, unless Tenant would be required to repair such damage under Section 6.3 or Section 6.4 herein; (iii) condemnation; and (iv) permitted Improvements, unless Landlord requires their removal under Section 6.1 herein. On surrender, Tenant shall remove from the Premises its personal property, trade fixtures, any Improvements required to be removed under Section 6.1 herein, and, at Landlord’s request given to Tenant at least ninety (90) days prior to the scheduled Termination Date (unless the termination is due to Tenant’s default, in which case Tenant will remove such cabling and wiring upon Landlord’s request without notice, or reimburse Landlord for the cost of such removal if Landlord removes the same), Tenant shall remove any communications or computer cabling and wiring placed in the Premises or other parts of the Building (including, without limitation, the Data Center) by Tenant, and Tenant shall repair any damage to the Premises or the Building (or reimburse Landlord for the cost of the same) caused by any such removal of such personal property, trade fixtures, Improvements or cabling and wiring, required in this Section 6.7. Any items not removed by Tenant as required above shall be considered abandoned unless the parties agree otherwise in writing. Landlord may dispose of abandoned items as Landlord chooses and xxxx Tenant for the cost of their removal and disposal, minus any revenues received by Landlord for their disposal.
Surrendering the Premises. Upon the Expiration Date or earlier termination of this Lease, Tenant shall surrender the Premises to Landlord in the same condition that the Premises were in on the Commencement Date except for: (i) ordinary wear and tear; (ii) damage by the elements, fire, and other casualty unless Tenant would be required to repair under paragraph 6.03(a); (iii) condemnation; (iv) damage arising from any cause not required to be repaired or replaced by Tenant; and (v) alterations as permitted by this Lease unless consent was conditioned on their removal.

Upon surrendering the Premises, Tenant shall remove from the Premises Tenant's personal property, trade fixtures, and any alterations required to be removed under this Subsection and repair any damage to the Premises caused by such removal. Any items not removed by Tenant as required above shall be considered abandoned. Landlord may dispose of abandoned items as Landlord chooses and charge Tenant for the cost of their disposal, less any revenues received by Landlord for their disposal. Parking. Landlord represents and warrants to Tenant that there are sufficient parking spaces located in the parking areas servicing the Project as required by all applicable zoning ordinances. Based on Tenant's use w of the Premises as permitted under this Lease, Tenant shall be entitled to the non-exclusive use up to a maximum of ONE HUNDRED FORTY-FOUR (144) unassigned spaces in the Project parking area, to be used by Tenant, its employees, customers, clients and invitees; provided that such maximum parking space allowance is calculated on the basis of six (6) spaces per 1,000 square feet of net rentable floor area of the Premises, and in the event of any adjustment to said net rentable floor area as provided herein, the maximum parking space allowance shall be recalculated accordingly. Tenant shall cooperate with Landlord as necessary to confirm that Tenant is in compliance with the limitations set forth in this Subsection. TENANT'S RIGHTS AND OBLIGATIONS Alterations.
Surrendering the Premises. Upon the Termination Date, Xxxxxx shall surrender the Premises to Landlord in the same condition as the Premises were in on the Commencement Date, except for ordinary wear and tear, any casualty and repairs which are not Tenant's responsibility hereunder. On surrender, Tenant shall remove from the Premises its personal property, trade fixtures, and any alterations required to be removed under Section 4.01 and repair any damage to the Premises caused by the removal. Any items not removed by Tenant as required above shall be considered abandoned. Landlord may dispose of abandoned items as Landlord chooses and xxxx Xxxxxx for the cost of their disposal. The foregoing shall not be construed as requiring Tenant to remove any Personalty located within the Premises as of the Commencement Date.
Surrendering the Premises. On or before the expiration or any earlier termination of this Lease, Tenant, at its expense, shall: (a) surrender the Premises to Landlord in the same condition that the Premises were in on the Commencement Date except for: (i) ordinary wear and tear that is consistent with the Tenant’s Use; (ii) condemnation; (iii) the terms and conditions of Section 13 below and (iv) any Alterations made by Xxxxxx; and (b) remove from the Premises Tenant’s personal property, equipment, and trade fixtures, and repair and restore any damage to the Premises resulting therefrom. At Landlord’s option, any items not so removed by Tenant as required above shall be considered abandoned and shall automatically become Landlord’s property, and in such event this Lease shall constitute a bill of sale for such items. Alternatively, if Tenant fails to perform any of its obligations under this Section 7.4, then: (i) Landlord may elect to perform the same, at Tenant’s sole cost and expense, which costs and expenses shall be paid by Tenant to Landlord on demand as Additional Rent, and if Tenant fails to pay the expenses incurred by Landlord in connection therewith within five (5) days after demand therefor, interest shall accrue on such expenses at the Default Rate until paid, and (ii) Tenant shall indemnify, defend and hold Landlord harmless from any costs, fees, expenses, damages, suits, claims or awards incurred or suffered by Landlord as result therefrom. Tenant’s obligations under this Section 7.4 shall survive the expiration or earlier termination of this Lease.

Surrendering the Premises. Upon the expiration of the Term or the earlier termination of this Lease, Tenant shall surrender the Premises to Landlord in broom clean condition similar to the condition that the Premises were in on upon the completion of the Initial Tenant Improvements, except for ordinary wear and tear and damage by the elements, fire, or other casualty or condemnation. Upon surrender, Tenant shall remove from the Premises its personal property and trade fixtures and repair any damage to the Premises caused by the removal, and comply with the provisions of Section 1.06 with respect to the Personal Property. Any items not removed by Tenant as required above shall be considered abandoned. Landlord may dispose of abandoned items as Landlord chooses and xxxx Xxxxxx for the cost of their disposal, minus any revenues received by Landlord for their disposal. If Tenant constructs any special facilities (including, without limitation, a gym or fitness area), upon surrender of the Premises the area where the special facilities were located shall be restored by Tenant to its condition at the time possession of said area was delivered to Tenant, unless otherwise agreed in writing at that time by Landlord. With respect to any other Alterations (defined below), Tenant upon surrender of the Premises shall comply with any removal requirements specified when Landlord gave its written consent to those Alterations.
Surrendering the Premises. Upon the Initial Term Ending Date or the date the last extension Term, if any, ends, whichever is later, Tenant shall surrender the Premises to Landlord in the same broom clean condition that the Premises were in on the Initial Term Beginning Date except for (a) ordinary wear and tear; (b) damage by the elements, fire, and other casualty; (c) condemnation; (d) damage arising from any cause not expressly required to be repaired or replaced by Tenant; and (e) alterations as permitted by this Lease, unless Landlord’s consent to the alteration was conditioned, in writing, on their removal at the time such consent was given (which Landlord shall only be permitted to do (i) reasonably and (ii) if the Alterations at issue are not of a nature and type that are commonly found in commercial office buildings in the Sterling, Virginia area. Landlord agrees that, in any event, cabling and wiring shall not be required to be removed. On surrender Tenant shall remove from the Premises its personal property, moveable trade fixtures, and any alterations required to be removed in accordance with Section 3.7 above and repair any damage to the Premises caused by the removal. Any items not removed by Tenant as required above shall be considered abandoned. Landlord may dispose of abandoned items as Landlord chooses and xxxx Tenant for the cost of their disposal, minus any revenues received by Landlord for their disposal.
