Permitted Improvements definition

Permitted Improvements means the Solar Energy Facility that will be used to conduct the Permitted Use, together with accessory uses thereto, including, but not limited to, access roads and electric interconnection facilities, as further set forth in Article 9 and Exhibit B hereto.
Permitted Improvements means landscaping or planting of vegetation, drainage improvements, fences, driveways and sidewalks or similar improvements; but shall not mean the construction of a fence, building or structure that will, in Grantee’s reasonable opinion, interfere with Grantee’s rights hereunder.
Permitted Improvements means any alterations, additions, modifications or attachments to the Equipment that are of a kind that customarily are made by owners of equipment similar to the Equipment, free and clear of any and all Liens (other than the Liens created pursuant to the Transaction Documents), and that do not and could not reasonably be expected to: (a) reduce the value or general usefulness of the Equipment; (b) impair the certification, performance, safety, quality, capability, function, specifications, use or character of the Equipment or alter the purpose for which such Equipment was obtained by Borrower, as described by Borrower to Lender in requesting Lender to enter into the Transaction Documents; (c) be inconsistent with Applicable Laws, manufacturer's requirements or recommendations, or any warranty, service agreement or license; (d) expose any Equipment to any Lien or other adverse interest or circumstance; (e) adversely affect insurance coverage benefiting Lender hereunder; or (f) negatively affect the resale value of the Equipment.

Examples of Permitted Improvements in a sentence

  • Tenant, however, shall first notify Landlord of such Permitted Improvements so that Landlord may post a Notice of Non-Responsibility on the Premises.

  • Except for the Permitted Improvements, Tenant shall neither install any signs, fixtures, or improvements, nor make or permit any other alterations or additions (individually, an “Alteration”, and collectively, “Alterations”) to the Premises without the prior written consent of Landlord, which consent shall not be unreasonably withheld so long as any such Alteration does not affect the Building systems, structural integrity or structural components of the Premises or Building.

  • The Leasehold Mortgagee and any other Financier shall be entitled to receive notice of any default by Lessee, provided that such Leasehold Mortgagee or Financier shall have first delivered to Lessor a notice of its interest in the Leasehold Mortgage or such other interests in the Lessee, the Solar Energy Facility or the Permitted Improvements, in the form and manner, if any, provided by state laws, rules, regulations, Lessee’s procedures, and the provisions of this Lease.

  • Within ninety (90) days following the Full Operations Date, Lessee shall prepare and deliver to Lessor detailed as-built plans accurately depicting the Permitted Improvements including, without limitation, all underground structures.

  • Such obligations, in addition to Lessee’s obligations to maintain and repair the Permitted Improvements, shall include, but not be limited to, maintaining the Permitted Improvements in a condition of commercial operation, and taking all actions necessary or desirable to comply with the Applicable Legal Requirements.

  • Lessee covenants to Lessor that Lessee shall be responsible for all costs related to capital improvements to the Premises, including, without limitation, those costs necessary to construct, operate, maintain, repair, remove, replace, and expand the Permitted Improvements.

  • During the course of construction of the Permitted Improvements, Lessee will carry or cause Lessee’s contractor(s) to carry (and cause each such contractor to cause its subcontractors to carry) adequate workers’ compensation insurance and such other insurance as is specified in Article 5.

More Definitions of Permitted Improvements

Permitted Improvements means any Improvements installed, constructed, maintained or allowed to stand on the Property in conformity with this Declaration.
Permitted Improvements means landscaping or planting of vegetation, driveways and sidewalks; but shall not mean the construction of a building or structure unless such installation or construction is approved in writing by the Grantee.
Permitted Improvements means the addition of a garage or storage space to a Residential Unit or the improvement of unfinished space in a Residential Unit allowed to be finished and occupied under the Uniform Building Code in effect at the time of such improvement, but does not include any other improvements, upgrades or work on or expenses incurred in connection with the Residential Unit.
Permitted Improvements means such additions and/or improvements as are allowed and may be approved by the SCHA or the Town.

Related to Permitted Improvements

  • Leasehold Improvements means all buildings, structures, improvements and fixtures located on any Leased Real Property which are owned by any Group Company, regardless of whether title to such buildings, structures, improvements or fixtures are subject to reversion to the landlord or other third party upon the expiration or termination of the Lease for such Leased Real Property.

  • Leased Improvements shall have the meaning given such term in Section 2.1(b).

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.

  • Site Improvements means any construction work on, or improvement to, streets, roads, parking facilities, sidewalks, drainage structures and utilities.

  • Capital Improvements mean the purchase, renovation, rehabilitation, or construction of permanent land, buildings, structures, equipment and furnishings used directly for or in the Project, and any goods or services for the Project that are purchased and capitalized under GAAP, including any organizational costs and research and development costs incurred in Illinois. Capitalized lease costs for land, buildings, structures or equipment shall be included in “Capital Improvements” only if the lease term, including any extensions or options to extend, equals or exceeds the term of this Agreement, and provided that such lease costs are valued at their present value using the corporate interest rate prevailing at the time the Company filed its Application with the Department.

  • Minimum Improvements means the acquisition of land and construction of a 152-unit market rate residential apartment building, construction of a stormwater pond and related improvements. The Minimum Improvements are more fully depicted in Exhibit B, which is attached hereto and incorporated herein.

  • Improvements means the buildings, structures, improvements, and alterations now constructed or at any time in the future constructed or placed upon the Land, including any future replacements and additions.

  • Licensee Improvements means any enhancement to or modification or improvement of the Licensed Patents and/or the Proprietary Information created by or on behalf of Licensee and/or any of its subsidiaries.

Unsatisfactory: the Educator’s performance on a standard or overall has not significantly improved following a rating of needs improvement, or the Educator’s performance is consistently below the requirements of a standard or overall and is considered inadequate, or both.

  • Infrastructure Improvements means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. Infrastructure improvements also include 1 or more of the following whether publicly or privately owned or operated or located on public or private property:

  • Building Equipment shall have the meaning set forth in the Security Instrument.

  • Permitted Facility means a facility authorized by the general permit to discharge total nitrogen or

  • Building, structure, facility, or installation means all of the pollutant-emitting activities which belong to the same industrial grouping, are located on one or more contiguous or adjacent properties, and are under the control of the same person (or persons under common control) except the activities of any vessel. Pollutant-emitting activities shall be considered as part of the same industrial grouping if they belong to the same major group (i.e., which have the same two-digit code) as described in the Standard Industrial Classification Manual, 1972, as amended by the 1977 Supplement (U.S. Government Printing Office stock numbers 4101-0066 and 003-005-00176-0, respectively).

  • Tenant Improvements Defined in Exhibit B, if any.

  • Permitted Installation means the activities and the limits to those activities described in Table 1.1.1 of this Permit.

  • Private Improvements means the improvements to be constructed on the Property that are not Public Improvements.

  • Public improvement means projects for construction, reconstruction or major renovation on real property by or for a public agency. “Public Works” shall mean roads, highways, buildings, structures and improvement of all types, the construction, reconstruction, major renovation or painting of which is carried on or contracted for by any public agency to serve the public interest by does not include the reconstruction or renovation of privately owned property which is leased by a public agency.

  • Infrastructure improvement means permanent infrastructure that is essential for the public health and safety or that:

  • Specialty Alterations means Alterations consisting of kitchens, executive bathrooms, raised computer floors, computer installations, vaults, libraries, internal staircases, dumbwaiters, pneumatic tubes, vertical and horizontal transportation systems, and other Alterations of a similar character.

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Capital Improvement or "Capital Improvement Project" means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities of Local Subdivisions, including real property, interests in real property, and facilities and equipment of Local Subdivisions related or incidental thereto.
