Survivor Rights. Upon the death of the retiree, the surviving spouse and 42 eligible dependent(s) shall have the option of buying into the District Medical 43 benefits program consistent with the coverage offered to active employees at 44 the time of the retiree’s retirement by the timely payments of premiums as 1 stipulated by the District for the lifetime of the spouse or until such time as 2 s/he is no longer eligible as defined in language above.
Survivor Rights. In the event of Executive’s death after execution of this Agreement, this Agreement shall operate in favor of his estate (“Estate”); provided, however, in the event of Executive’s death, the Employer may accelerate all remaining sums owed to Executive pursuant to this Agreement and pay such amount, discounted to present value, in a lump sum to Executive’s Estate.

In the event of the death of the retiree prior to the spouse or 37 dependent reaching the age of Medicare eligibility (currently, age 65), the spouse 38 or dependent may buy the plan consistent with the coverage offered to active 39 employees at the time of retirement, under the terms described herein, until 40 s/he reaches the age of Medicare eligibility (currently, age 65). 41
