Technology Products. Computer or telecommunications hardware or software products, components or peripherals or electronic products or components: 1. created, designed, distributed, manufactured, or sold by or on behalf and for the benefit of an Insured; and 2. leased or licensed by an Insured to third parties, including software updates, service packs and other maintenance releases provided for such products.

Technology Products. Any computer hardware, firmware, software, or related electronic product, equipment or device, specifically designed or intended for use in connection with any Technology Services, telecommunication systems or telecommunication service that is created, manufactured, developed, distributed, licensed, leased or sold: 1. by the Insured; 2. for any Insured by others acting under the Insured’s trade name.
Technology Products. With respect to Products comprised, either in part or in whole, of software or other technology (“Technology Products”), Supplier further warrants that: (i) It uses industry best practices to ensure, and to the best of Supplier’s knowledge, Technology Products do not contain any virus, worm, Trojan horse, or similar malware or destructive code that may destroy, modify, alter, or cause the destruction, modification or alteration, in whole or in part, of any Flyer’s equipment, devices, software, or data or permit unauthorized access to any of the foregoing, including the Technology Products; (ii) Unless expressly agreed otherwise in a signed writing, no hardware or software Technology Products, including operating systems and embedded software, or any component thereof, will contain any (a) “phone-home”, metering, or other feature designed to periodically transmit usage, statistical or other data to Supplier or (b) hardware or software designated as end-of-life (e.g., no longer supported or updated by the manufacturer or licensor) prior to the date of the relevant Purchase Order; (iii) Neither Supplier nor any of its agents, contractors, or employees or anyone acting on their behalf, will disable or interfere, in whole or in part, with use of the Technology Product or any software, hardware, systems or data owned, utilized or held by Flyer without Flyer’s prior written consent, whether or not the disablement is in connection with any dispute between the parties or otherwise; (iv) It will conduct application security assessment review(s), including penetration tests and code review, to identify common security vulnerabilities as identified by industry-recognized organizations (e.g., OWASP Top 10 Vulnerabilities; CWE/SANS Top 25 vulnerabilities) for all major releases, as determined by Flyer, of the Technology Products, but in any event no less than every twelve

Technology Products. The University participates in an agreement with other component institutions of The University of Texas System for purchasing discounted Microsoft® software products, which Licensee, as the sub-licensee of University, must make available, along with other University-approved software, to faculty, staff, and students in the Campus Bookstore, at University's option. University reserves the right to determine which software products Licensee will offer for sale in the Campus Bookstore and to limit to whom and on what terms such software shall be made available, so that University may comply with its obligations under any and all applicable licensing and related agreements. Licensee shall ensure that prices for computer software in the Campus Bookstore will not be greater than prices received from manufacturers under their various higher education pricing options, including the System-wide agreement concerning Microsoft® software products.
