TEMPORARY IMPAIRMENT. Tesla agrees that City shall have the right to temporarily access and/or temporarily restrict access to a portion of the Premises to perform routine parking lot maintenance, provided that City shall use commercially reasonable efforts to minimize any impairment of the Premises, including, without limitation, by limiting such impairment to times of day and days of the week that are not busy charging periods, and (c) except in the case of snow removal, garbage collection or an emergency, City shall provide Tesla at least fifteen (15) days advance written notice stating the date, time, duration and scope of the planned impairment.

TEMPORARY IMPAIRMENT. Tesla agrees that Counterparty shall have the right to temporarily access and/or temporarily restrict access to a portion of the Premises and Licensed Area to perform routine parking lot maintenance, provided that Counterparty shall use commercially reasonable efforts, as determined by Counterparty, to minimize any impairment of the Premises and Licensed Area, including, without limitation, by limiting such impairment to times of day and days of the week that are not busy charging periods, and except in the case of snow removal (except as provided in Section 12), garbage collection, restriping, or an emergency, Counterparty shall provide Tesla at least thirty (30) days advance written notice stating the date, time, duration and scope of the planned impairment.
TEMPORARY IMPAIRMENT. If the Executive, in the reasonable opinion of a physician selected by the Board, is unable or incompetent mentally or physically, even with reasonable accommodation, to perform the essential functions of his job or devote his best efforts (measured against prior performance) to the Company for more than 30 work days in any 12-month period, subsequent compensation (including salary) shall be paid (or accrued) only with respect to those work days during which the Executive is able, in the reasonable opinion of a physician selected by the Board, with or without reasonable accommodation, to perform the essential functions of his job or devote his best efforts (measured against prior performance) to the Company. These provisions on temporary impairment shall in no way affect the Company's rights to terminate the Executive under Section 4(a) hereof, which rights may also be exercised during any period of temporary impairment. Any salary payable (or accrued) during the 30-day period of inability or incompetence shall be reduced by any amounts payable to the Executive under a disability insurance plan maintained by the Company, and no compensation shall be paid (or accrued) for such 30-day period if the temporary impairment is the fault of the Executive.
TEMPORARY IMPAIRMENT. Xxxxx agrees that the Licensor shall have the right to temporarily access and/or temporarily restrict access to a portion of the Premises to perform routine parking lot maintenance, provided that Licensor shall use commercially reasonable efforts to minimise any impairment of the Premises, including without limitation, by limiting such impairment to times of day and days of the week that are not busy charging periods, and (c) except in the case of an emergency, Licensor shall provide Tesla with at least 14 days prior written notice starting the date, time, duration and scope of the planned impairment.

  • Work Environment It is mutually agreed that the prevention of accidents and injuries to state employees will result in greater efficiency of operations of state government.   • Responsibility for Environmental Contamination 5.20.1 Neither Party shall be liable to the other for any costs whatsoever resulting from the presence or release of any Environmental Hazard that either Party did not introduce to the affected Work Location. Except for abatement activities undertaken by CLEC or equipment placement activities that result in the generation of asbestos-containing material, CLEC does not have any responsibility for managing, nor is it the owner of, nor does it have any liability for, or in connection with, any asbestos-containing material. Qwest agrees to immediately notify CLEC if Qwest undertakes any asbestos control or asbestos abatement activities that potentially could affect CLEC personnel, equipment or operations, including, but not limited to, contamination of equipment.

  • Musculoskeletal Injury Prevention and Control The hospital in consultation with the Joint Health and Safety Committee (JHSC) shall develop, establish and put into effect, musculoskeletal prevention and control measures, procedures, practices and training for the health and safety of employees.

  • Materials of Environmental Concern have not been transported or disposed of from the Properties in violation of, or in a manner or to a location which could give rise to liability under, any Environmental Law, nor have any Materials of Environmental Concern been generated, treated, stored or disposed of at, on or under any of the Properties in violation of, or in a manner that could give rise to liability under, any applicable Environmental Law, except insofar as any such violation or liability referred to in this paragraph, or any aggregation thereof, could not reasonably be expected to result in the payment of a Material Environmental Amount.

  • Promotion to a Higher Classification An employee who is promoted to a higher rated classification within the bargaining unit will be placed in the range of the higher rated classification so that he shall receive no less an increase in wage rate than the equivalent of one step in the wage rate of his previous classification (provided that he does not exceed the wage rate of the classification to which he has been promoted).
