Tenant Options. Notwithstanding anything to the contrary contained in this Agreement, provided Tenant is not then in default under terms of the related Lease or this Agreement, Tenant may exercise any of the Options or renewal rights granted to it under, and in strict accordance with the terms of, such Lease; provided, however, Tenant acknowledges that Landlord's ability to convey all or any portion of the Premises free and clear of the lien of the Security Documents shall be subject to the fulfillment by Landlord of all terms, provisions and conditions contained in Section 2.19(c) of the Credit Agreement.
Tenant Options. Tenant and Successor Tenant acknowledge and agree that they have no rights of renewal, expansion, first offer, refusal, reduction, termination, nor does it have any rights to any tenant improvements (including, without limitation, signage), rent abatement or tenant improvement allowances, whatsoever with respect to the Premises, unless specifically set forth in this Amendment. Tenant and Successor Tenant specifically waive their right of option to renew, as well as their right of first offer, as originally granted in the Lease. Tenant and Successor Tenant further acknowledge and agree that Landlord is no longer in possession of any security deposit, and as such, Tenant and Successor Tenant have no rights to any refund of any security deposit.

Tenant Options. Any applicable pre-emptive rights of purchase in favor of any tenant of the Property, which is or could be triggered by the transactions referred to herein, shall have been irrevocably waived.

Tenant Options. The Building's HVAC system is designed and constructed in anticipation of office occupancy loads. However the capacity of the cooling and heating systems and a portion of the air handling system have the capability to support a limited amount of more-intense heating and cooling requirements, including laboratory occupancies.
Tenant Options. The Building's plumbing system is designed for office occupancy. However a tenant has the opportunity to install supplementary systems for its special occupancy needs, including research laboratories. Hot water generating systems for laboratories or kitchens, vacuum, gas, pure water, non-potable water, and laboratory waste collection, treatment and ph-monitoring systems can be installed in the Building at tenant cost with landlord approval. Tenant Options. The Building sprinkler system may be modified by a tenant to suit its particular occupancy needs and hazard levels within the capability of the Building's fire pump and piping systems. These modifications, taken after receipt of approval of the Building owner and insurance underwriter, may include changes in type, or re-locations, of sprinkler heads, changes in density of coverage (e.g laboratory occupancies may require increasing sprinkler density to Ordinary Hazard Group 1) and the like. Tenant Options. The Schedule of Tenant Options furnished by such Transferor to the REIT is true, accurate and complete and the Tenant Options delivered by such Transferor to the REIT constitute true, accurate and complete copies of all Tenant Options. Such Transferor has not received any notice that such Transferor is in default under any of such Tenant Options, nor does any default or breach exist, nor any event or circumstance which, with the giving of notice, or passage of time, or both, would constitute a default or breach under Tenant Options.
