Tenant’s Right to Possession. Provided Tenant pays the Rent and fully performs all of its other covenants and agreements under this Lease, Tenant shall have the right to occupy the Premises without hindrance from Landlord or any person lawfully claiming through Landlord, subject to the terms of this Lease, all Mortgages, insurance requirements and applicable Law. This covenant and all other covenants of Landlord shall be binding upon Landlord and its successors only during its or their respective periods of ownership of the Building, and shall not be a personal covenant of any Landlord Parties.

Tenant’s Right to Possession. Notwithstanding any postponement or subordination referred to herein, the Tenant acknowledges that its obligations under this Lease shall remain in full force and effect notwithstanding any action at any time taken by a mortgagee, chargee or ground lessor to enforce the security of any mortgage charge, ground lease, trust deed or debenture; provided, however, that any postponement or subordination given hereunder shall reserve to the Tenant the right to continue in possession of the Leased Premises under the terms of this Lease so long as the Tenant shall not be in default hereunder.

Landlord represents and warrants to Tenant that no restrictive covenant or other recorded matter that affects the Premises prohibits the use of the Premises for the Permitted Use.
Tenant’s Right to Possession. Upon an event of breach of this Lease by Tenant, in addition to any other rights or remedies it may have, State may give Tenant a three-day notice to cure the breach or quit the Lease area. If Tenant fails to do either, State may bring a statutory proceeding in unlawful detainer to regain possession of the Lease area. Any notice give by State pursuant to this paragraph does not constitute a termination of this Lease unless expressly so declared by State in the notice. In the absence of written notice from State, no act by State, including, but not limited to, acts of maintenance, efforts to re-let and/or assign rights to possession of the Lease area, or the appointment of a receiver on State's initiative to protect State's interest under this Lease shall constitute an acceptance of Tenant’s surrender of the Lease area, or constitute a termination of this Lease or of Tenant's right to possession of the Lease area. Upon such termination, State has the right to recover from Tenant:

THIS COVENANT AND ALL OTHER COVENANTS OF LANDLORD SHALL BE BINDING UPON LANDLORD AND ITS SUCCESSORS ONLY DURING ITS OR THEIR RESPECTIVE PERIODS OF OWNERSHIP OF THE Property.

Tenant’s Right to Possession. Prior to entry into or on the Premises Tenant shall provide to Landlord certificates of insurance evidencing the insurance which Tenant is required to obtain by Article 8, by Exhibit ”C”, and by any of the other provisions of this Lease; provided, however, Landlord may, at Landlord’s sole discretion, agree in writing to waive the requirement that certain certificates be provided during Tenant’s Construction and Fixture Period. Further, Landlord shall not be required to deliver possession to Tenant for any reason, including but not limited to construction or fixturization by Tenant, until Tenant provides Landlord with all certificates of insurance required by Article 8 and with all plans and drawings required by Exhibit ”C” to this Lease. Such delay shall not, however, delay the Term Commencement, Rent Commencement Date, or any other obligations of Tenant under this Lease.
Tenant’s Right to Possession. Provided Tenant is not in default beyond any applicable cure periods, Landlord agrees to warrant and defend Tenant’s rights under this Lease to enjoy possession of the Premises against any party claiming by, through or under Landlord, subject to the terms of this Lease, all Mortgages, insurance requirements and applicable Law. This covenant and all other covenants of Landlord shall be binding upon Landlord and its successors (provided such successor assumes such obligations in writing) only during its or their respective periods of ownership of the Building, and shall not be a personal covenant of any Landlord Parties.
