Termination and Reletting. Should there occur an early termination of this Agreement pursuant to the terms of this Agreement, Authority shall have the right to reenter the Operations Areas of Operator, make repairs necessary, and enter into another agreement for lease of the Operations Areas, or any part thereof, for the remainder of the term hereof. In the event of such early termination, Operator shall remain liable for such payments whether or not another Agreement is entered into, Authority's responsibility being in mitigation of damages as provided herein.
Termination and Reletting. If Landlord elects to terminate this Lease pursuant to Section 9.03A, Landlord may, if it elects, enter into a new lease covering the Premises with the intended assignee or sublessee on such terms as Landlord and such person may agree or enter into a new lease covering the Premises with any other person; in such event, Tenant shall not be entitled to any portion of the profit, if any, which Landlord may realize on account of such termination and reletting. From and after the date of such termination of this Lease, Tenant shall have no further obligations arising hereunder prior to the date of such termination, except those obligations expressly provided to survive termination of this Lease.

In the event of such early termination, Concessionaire shall remain liable to Authority for the full amount of all fees and charges, except the percentage fee under Article 5.03, and shall continue to pay the same or such part thereof that remains unpaid after the application of the fees and charges collected by Authority from such other agreement for the Assigned Area and privileges or any part thereof. Concessionaire shall remain liable for such payments whether or not another agreement is entered into, Authority's responsibility being in mitigation of damages as provided herein.

In the event of such early termination, Concessionaire shall remain liable to the City for the full amount of all fees and charges, except the percentage fee under Article 6.1, and shall continue to pay the same or such part thereof that remains unpaid after the application of the fees and charges collected by the City from such other agreement and privileges or any part thereof. Concessionaire shall remain liable for such payments whether or not another agreement is entered into, the City’s responsibility being in mitigation of damages as provided herein.
Termination and Reletting. Should there occur an early termination of this Concession pursuant to the terms of Subsection 12.2 hereof, the ENGLAND AUTHORITY shall have the right to enter the Premises and take possession thereof. CONCESSIONAIRE shall remain liable to the ENGLAND AUTHORITY for the full amount of all fees and charges, and shall continue to pay same until a Concession Agreement with another Concessionaire is granted by the ENGLAND AUTHORITY or until the last day of the Term of this Concession whichever sooner occurs.

Should there occur an early termination of this Concession Lease pursuant to this Section, the County shall have the right to reenter the Leased Premises, make repairs as necessary, and enter into another lease for the Leased Premises and privileges, or any part thereof, for the remainder of the term hereof.

In the event of such early termination by Authority pursuant to Section 10.02, Concessionaire shall remain liable to Authority for the full amount of all fees and charges, all costs of repair and finding a new Concessionaire and the Annual Concession Fee under Article 4.01, and shall continue to pay the same or such part thereof that remains unpaid after the application of the fees and charges collected by Authority from such other agreement for the Assigned Premises and privileges or any part thereof. Concessionaire shall remain liable for such payments whether or not another agreement is entered into, Authority's responsibility being in mitigation of damages as provided herein.
Termination and Reletting. In addition to any other remedies available to the City, in the event of an early termination of this Agreement for any reason, to include termination due to an Event of Default, the City shall have the right to reenter and take possession of the Assigned Area, removal Concessionaire’s personal property, make any necessary repairs and enter into another agreement for use and/or occupancy of the Assigned Area, or any part thereof, for the remainder of the Term. In the event of such early termination, Concessionaire shall remain liable to the City for the full amount of all fees and charges due under this Agreement and shall continue to pay the same or such part thereof that remains unpaid, together with interest thereon at the rate of eighteen percent (18%) per annum. Concessionaire shall remain liable for such payments whether or not another agreement for the use and/or occupancy of the Assigned Area is entered into, subject to the City’s duty to reasonably mitigate its damages.
