Termination for Lack of Appropriations. If, during any year of this Agreement, legislation establishing an Annual Maximum Payment Amount for the following year is not enacted, this Agreement will terminate in its entirety on the last day of the Term for which an Annual Maximum Payment Amount has been legislatively authorized; provided, however, that Task Orders funded out of a previously legislatively authorized Annual Maximum Payment Amount may continue beyond such termination date.
Termination for Lack of Appropriations. The parties acknowledge and agree that the City is a municipal corporation and political subdivision of the state of Florida, and as such, the City’s Net Metering Program and this Agreement are subject to budgeting and appropriation by the City of funds sufficient to pay the costs associated with the City’s Net Metering Program in any fiscal year of the City. Notwithstanding anything in the City’s Net Metering Program or this Agreement to the contrary, in the event that no funds are appropriated or budgeted by the City’s governing board in any fiscal year to pay the costs associated with the City’s Net Metering Program and/or obligations under this Agreement, or in the event the funds budgeted or appropriated are, or are estimated by the City to be, insufficient to pay the costs associated with the City’s Net Metering Program and/or obligations hereunder in any fiscal period, then the City will notify the Customer of such occurrence and either the City or the Customer may terminate this Agreement by notifying the other in writing, which notice shall specify a date of termination no earlier than twenty-four (24) hours after giving of such notice. Termination in accordance with the preceding sentence shall be without penalty or expense to the City of any kind whatsoever; however, City shall any amounts then due to the Customer under the City’s Net Metering Program through the date of termination.

Termination for Lack of Appropriations. It is understood and agreed that this Agreement shall be subject to annual appropriations by the County.
9.1.1 Recognizing that termination for lack of appropriations may entail substantial costs for CCS and the County shall act in good faith and make every effort to give CCS reasonable advance notice of any potential problem with funding or appropriations.
Termination for Lack of Appropriations. The parties agree that this Agreement shall be subject to annual appropriations by the County Board of the County. Recognizing that termination for lack of appropriations may entail substantial costs for Contractor, the County and the Sheriff will act in good faith and make every effort to give Contractor notice of any potential problem with funding or appropriations. The County shall provide notice in writing to Contractor of a minimum of 90 days. Notwithstanding any other provision in this Contract, the terms of this Contract are contingent upon the City Council of the City of Albuquerque making the appropriations necessary for the performance of this Contract. If sufficient appropriations and authorizations are not made by the City Council, or if the City Council un-appropriates or deauthorizes funds during a fiscal year, this Contract may be terminated upon thirty (30) days’ written notice given by the City to all other parties to this Contract. Such event shall not constitute an event of default. All payment obligations of the City and all of its interest in this Contract will cease upon the date of termination. The City's determination as to whether sufficient appropriations are available or have been made shall be accepted by all parties and shall be final.
