TERMS OF COMPLIANCE. The Mandatory COVID-19 Vaccination Policy, outlined in San Diego Ordinance O-21398 (Nov. 29, 2021), requires ALL City of San Diego (City) contractors, who interact in close contact with City employees while providing contracted services indoors in City facilities or while performing bargaining unit work while indoors, to be fully vaccinated against COVID-19, effective January 3, 2022, as a condition for provision or continued provision of contracted services.

TERMS OF COMPLIANCE. 6.1. The UNWTO will issue its final acceptance of the services provided within one (1) month from the date of completion of services. During such period, the Contractor shall perform all work to repair, modification, reconstruction, rectification and improvement of defects, imperfections, shrinkage or other faults that the UNWTO requests in writing to the Contractor. 6.2. The Contractor shall perform any pending work at its own expense if the UNWTO deems that such need is a consequence of negligence or omission by the Contractor in the performance of any express or implied obligation under the Contract. 6.3. Furthermore, if the Contractor fails to perform any pending work in accordance with Article 6.2, the UNWTO shall be entitled to employ and pay other persons to carry out such work, and may recover all expenses arising or deriving therefrom, or deduct them from any monies due or which may become due to the Contractor. 6.4. All time periods of performance contained in the Contract shall be deemed essential for the performance of the provision of the Services.

The decision to source experts from outside the Contract shall be at the sole discretion of the UNWTO and the Contractor shall actively collaborate with the experts sourced by the UNWTO for the implementation of projects to fully integrate the tasks of these experts in the project planning and outputs. 6.4. All time periods of performance contained in the Contract shall be deemed essential for the performance of the provision of the Services.

The Contractor shall perform any pending work at its own expense if the UNWTO deems that such need is due to the Contractor's use of materials and labour that are not compliant with the conditions of the Contract or negligence or omission by the Contractor in the performance of any express or implied obligation under the Contract. 6.4. Furthermore, if the Contractor fails to perform any pending work or to repair a defect in accordance with Article 6.2, the UNWTO shall be entitled to employ and pay other persons to carry out such work, and may recover all expenses arising or deriving therefrom, or deduct them from any monies due or which may become due to the Contractor. 6.5. All time periods of performance contained in the Contract shall be deemed essential for the performance of the provision of the Services.

TERMS OF COMPLIANCE. A contractor or subcontractor working on or under the authority of an agreement subject to the Living Wage Ordinance [LWO] must comply with all applicable provisions of the LWO unless specifically approved for an exemption. Basic requirements of the LWO are:

  • Certification of Compliance San Diego Municipal Code section 22.4225 requires each Bidder to fill out and file a living wage certification with the Living Wage Program Manager within thirty (30) days of Award of the Contract.

  • Statement of Compliance Contractor has, unless exempted, complied with the nondiscrimination program requirements. (Gov. Code §12990 (a-f) and CCR, Title 2, Section 11102) (Not applicable to public entities.)

  • Time for Compliance Consultant shall not commence work under this Agreement until it has provided evidence satisfactory to the City that it has secured all insurance required under this section. In addition, Consultant shall not allow any subconsultant to commence work on any subcontract until it has provided evidence satisfactory to the City that the subconsultant has secured all insurance required under this section. Failure to provide and maintain all required insurance shall be grounds for the City to terminate this Agreement for cause.
